The Office of General Counsel provides legal assistance and representation to management and statewide divisions and districts of the Department of Transportation.
Why does the job exist?
This position provides, but is not limited to, paralegal and administrative assistance to 11 attorneys in the Office of General Counsel.
This position will primarily assist attorneys with condemnation and inverse condemnation litigation, and other right-of-way matters, including quiet title lawsuits, encroachment proceedings, and various matters involving outdoor advertising, utilities and rail.
This position will prepare condemnation cases, this will include review of right-of-way maps and title reports in order to identify persons or entities having an interest in the property that is the subject of the condemnation lawsuit.
This position is also responsible for electronic filing of condemnation and other pleadings and overseeing the litigation calendar.
How does it get done?
The position requires electronic legal research, experience with the preparation of various legal pleadings, working knowledge of maps and title reports, experience interviewing witnesses and preparing trial exhibits.

For the department's Right-of-Way Bureau, management and New Mexico Department of Transportation (NMDOT) districts through out the state.

Minimum Qualification
Associate degree in Paralegal Studies and two (2) years of work experience drafting and preparing legal correspondence, conducting legal research, and maintaining a case management/tracking system. Any combination of education from an accredited college or university in a related field and/or direct experience in this occupation totaling four (4) years may substitute for the required education and experience.
Employment Requirements
Must possess and maintain a valid Driver's License. Must possess and maintain a current Defensive Driving Course certificate from the State of New Mexico or must pass and receive a Defensive Driving Course certificate as a condition of continued employment.
Pre-employment background investigation is required and is conditional pending results.
Working Conditions
Work is performed primarily in an office setting with exposure to visual/video display terminal (VDT) and extensive personal computer and phone usage. Sitting/standing, bending, squatting, climbing, reaching, and/or kneeling for extended periods of time may be required. Ability to lift up to 25 pounds, Travel may be required.
