The Assistant Agency General Counsel II (Deputy General Counsel) position develops advanced legal positions in complex legal matters of significant interest to the agency and to the State of North Carolina. This position provides daily oral and written legal advice and counsel to the General Counsel, Chief Deputy General Counsel, Director of Purchasing and Logistics, Director of Communications, Executive Directors of several boards and commissions in the department, Chief of Staff, division heads, and other employees on a myriad of topics related to their statutory duties and responsibilities. This position also serves as a liaison to the Attorney General’s Office and provides guidance as necessary or requested regarding statutes, policies, and rules applicable to pending litigation. This position decides the best legal strategy to use to best achieve the agency’s goals.
Specific responsibilities of the position include:
- Drafting advisory letters and formal opinions on new or complex legal issues; drafting statutes, policies, rules, and amendments which have a broad impact on programs or create new agency programs.
- Interpreting constitutional provisions, state and federal statutes, administrative rules and regulations, state and federal court decisions, and applies them to the department’s current operations to determine whether procedural or substantive changes should be made in the department’s policies and practices to ensure compliance with federal and state laws.
- Directing and supervising two (2) attorneys on a daily basis.
- Analyzing the strengths and weaknesses of cases to develop and execute effective litigation strategy and arguments to achieve the agency’s desired result.
- Monitoring pending litigation involving DPS and provides technical assistance to the Attorney General’s Office in matters related to procurement and public records laws, in anticipation of litigation or after litigation is filed.
- Providing legal advice to executive and senior management on the merits of litigation, settlement, and appeal in the areas of procurement and public records laws.
- Supervising subordinate legal staff to create and maintain the effective and timely provision of legal services to the General Counsel and the Department.
- Conducting or directing legal research and analysis of the broad spectrum of legal issues affecting agency action and providing legal advice based on the results of that research and the employee’s knowledge and experience.
- Examining and evaluating federal and state legislation, case law, administrative rules, and regulatory requirements, as well as consideration of secondary sources including relevant research, articles, and treatises.
- Completing tasks with a high level of precision and accuracy so as to avoid loss of credibility with legislators, as well as potential financial losses and/or legal liability.
- Representing executive management at mediations and court-hosted settlement conferences as needed (with settlement authority).
- Completing special assignments (usually confidential, highly sensitive and urgent in nature) which have been assigned by the Secretary, Chief of Staff, General Counsel or Chief Deputy General Counsel.
- Delivering training to DPS staff on an as needed basis.
This is a full-time position (40 hours per week) with State Benefits, including paid vacation, paid sick leave, paid holidays, retirement, and health insurance. To qualify for this position, applicants must demonstrate ALL of the following KSAs:
- Experience interpreting statutory and/or case law
- Experience providing legal advice
Management Preferences (Optional): These skills are not required but managers may choose to interview/select applicants who demonstrate Management Preferences.
- Experience with/knowledge of state and/or federal government procurement processes.
- Experience with/knowledge of NC public records laws.
Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

Military Experience
