Assistant General Counsel – Legal
Salary Range- $80,000.00-$100,000.00
GENERAL FUNCTION
Under direction, the Assistant General Counsel (AGC) provides legal counsel to the Oklahoma Tax Commission including policy and procedure review, litigation, legal research for various internal and external inquiries and pre-trial proceedings, contract writing and negotiating, and monitoring proposed legislation. This position will prepare and try both routine and progressively difficult cases.

Preference may be given to candidates who have extensive legal experience with tax laws.
Special Requirements
This position may require occasional travel. Applicants must have reliable transportation and be willing and able to perform all job-related travel. Possession and maintenance of a valid Oklahoma State Driver’s License is also required.
Core work hours for the Oklahoma Tax Commission are Monday through Friday, 7:30am to 4:30pm. This schedule may require minor flexibility based on the needs of the agency.
Telework may be required based on the needs of the agency, division, and section. If applicable, applicant must be willing and able to BOTH work on-site and telework at an off-site location, generally in the applicant’s home. Applicant must have a secure internet connection and a dedicated telephone (landline) or smart phone device during scheduled working hours.

Typical Functions
The functions performed by employees in this job family will vary by level, but may include the following:
- Prepares and presents the agency’s case in administrative hearings and cases involving litigation of the collection of state taxes before a district court
- Prepares briefs, motions and other documents preparatory or incidental to the trial of a case
- Analyzes factual and legal issues; reviews policies, procedures, regulations, and other related legal questions for the agency
- Conducts research of laws, policies, regulations, legal texts and cases
- Prepares memoranda or reports outlining facts and legal issues, prepares necessary legal documents and advisory opinions for administrative personnel
- Participates in pre-trial or pre-hearing conferences, conducts discovery, examines and cross-examines witnesses, argues motions before the Court or hearing officer and summarizes the agency’s case
- Conducts or participates in conferences with other legal counsel and reviews the opinions and suggestions of other staff attorneys
- Examines or interviews petitioners, claimants, and defendants involved in administrative proceedings of the agency and court proceedings brought by the agency
- Prepares reports, exhibits and legal memoranda from the records and hearings outlining the factual and legal issues and recommends disposition of a case
- Prepares and presents appeals, in both written and oral form, to higher courts of record
- Drafts or comments on proposed legislation or changes in regulations
- Confers and negotiates with Taxpayers to resolve delinquencies, tax reporting requirements and questions regarding their accounts
- Performs related work as required and assigned
Comprehensive Knowledge of
- Applicable tax laws, agency policies and procedures
- Methods and techniques for conducting legal research
- Legal principles and their application
- The scope of Oklahoma statutes and federal statutes, regulations, and policies; the Oklahoma Constitution; the principles of administrative and constitutional law; trial and hearing procedures; the rules of evidence
- Analytics, critical thinking, attention to detail, sound judgment and decision-making
- Legal research and writing skills
- Directing and/or performing independent and difficult research, analyzing, appraising and applying legal principles, facts, and precedents to difficult legal or factual problem
- Presenting statements of fact, law, and argument clearly and logically in written or oral form
- Presenting, explaining, or arguing cases to administrative commissions, boards, or courts
- Understand, interpret and apply applicable laws, agency policies and procedures
- Ensure timelines are being met while following tax laws/statutes of the State of Oklahoma
- Develop briefings, presentations, and reports; and conduct data analysis
- Represent the division and agency in a professional manner
