The duties that the incumbent of the vacancy will be expected to perform. Duties Description Hearing Officers preside at quasi-judicial or administrative hearings of an adversarial nature concerning the resolution of issues of fact, law and/or regulatory practice; make findings of fact and conclusions of law; and render determinations. The responsibilities of the Hearing Officer include the following: • Preside at small claims hearings held in various locations throughout New York State, involving New York State and City income, sales, corporation, and miscellaneous taxes.• Conduct hearings in a manner that is as fair, impartial, and informal as possible, consistent with orderly procedure. The Hearing Officer shall maintain control at all times, collecting and reviewing as much relevant testimony and evidence as possible. • Instructs parties of their rights and ensures due process.• Administers oaths and affirmations.• Organizes legal information or records; receives exhibits into evidence.• Writes small claims determinations after the completion of hearings. Determinations must contain findings of all relevant facts, that result in conclusions of law that must be well researched and logically presented. Conclusions are supported by appropriate references to cases, statutes, and regulations.• Determinations are issued within three months of the hearing’s conclusion or of the last brief filed, whichever date is later. Such determinations are binding on the parties and not subject to review by the Tax Appeals Tribunal.

The minimum qualifications required for this vacancy. Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS). NY HELPS Program titles may be filled via a noncompetitive appointment. This means that you do not need to take an exam to qualify, but you do need to meet the minimum qualifications of the title. If you are hired via HELPS, at a future date (within one year of permanent appointment), employees hired under NY HELPS are expected to have their permanent non-competitive employment status converted to permanent competitive status. You will not have to take an exam to gain permanent competitive status.Non-Competitive Minimum Qualifications: Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agencyCompetitive Minimum Qualifications: Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency.PREFERRED QUALIFICATIONS: The preferred candidate will be a member in good standing of the New York State (NYS) Bar with two years of satisfactory post-NYS Bar admission experience adjudicating, clerking, or litigating civil cases in a federal, state, trial or appellate court or an administrative agency. This experience must have been involved primarily with federal or state taxation, other than for real property or unemployment insurance taxation. TRANSFER OPPORTUNITIES: NYS employee with one year of permanent or contingent-permanent competitive service as a Hearing Officer (SG-25) who is eligible for a transfer under Section 52.6 of the Civil Service Law; ORNYS employee with one year of permanent or contingent-permanent competitive service as a Senior Attorney (SG-25) who is eligible for a transfer under Section 52.6 of the Civil Service Law and meet special qualifications.

DTA is New York State’s quasi-judicial administrative agency charged with resolving formal disputes between taxpayers and the Division of Taxation.The Hearing Officer 1 position is a full-time, permanent position in the Classified jurisdictional class, which reports to the Supervising Tax Law Judge. • Telecommuting up to 40% is permitted with supervisor’s approval after a probationary period.• Candidates from diverse backgrounds are strongly encouraged to apply.
