Job Summary:
We are seeking an experienced and dynamic General Counsel with a strong background in the nursing home and rehabilitation industry. This hands-on role is ideal for a legal professional who thrives in a fast-paced environment, is comfortable navigating complex regulatory frameworks, and has extensive courtroom experience. The General Counsel will provide strategic and operational legal guidance to ensure compliance with federal and state laws while managing litigation, risk, and legal processes for the organization.
Key Responsibilities:
1. Legal Counsel and Strategy:
- Advise executive leadership and operational teams on all legal matters, including compliance, litigation, risk management, and contracts.
- Develop and implement legal strategies to support business objectives while minimizing legal risks.
2. Litigation and Court Representation:
- Represent the organization in legal proceedings, including appearances in court, depositions, and administrative hearings.
- Manage external counsel and ensure effective case strategy and cost-efficient outcomes when outside representation is required.
3. Regulatory Compliance:
- Ensure compliance with all applicable federal and state regulations, including Medicare, Medicaid, HIPAA, and other healthcare-related laws.
- Stay updated on regulatory changes and implement policies to ensure organizational adherence.
4. Risk Management:
- Identify potential legal risks and proactively implement strategies to mitigate them.
- Oversee the resolution of complaints, grievances, and other legal disputes involving residents, families, or employees.
5. Contract Management:
- Draft, review, and negotiate contracts, including vendor agreements, lease agreements, and partnership arrangements.
- Ensure contracts align with organizational objectives and regulatory requirements.
6. Staff Education and Training:
- Provide training to staff on legal and regulatory compliance, including risk mitigation strategies, patient rights, and ethical considerations.
- Serve as a resource for resolving legal and compliance-related questions from staff and leadership.
7. Collaboration and Leadership:
- Work closely with administrators, directors, and other stakeholders to align legal initiatives with organizational goals.
- Serve as a trusted advisor and advocate for the organization's best interests.
Qualifications:
· Juris Doctor (JD) degree from an accredited law school and active membership in good standing with the relevant state bar.
· Minimum of 7-10 years of legal experience, with at least 3-5 years in the nursing home, rehabilitation, or healthcare sector.
· Proven courtroom experience, including handling litigation, administrative hearings, and settlement negotiations.
· Strong knowledge of healthcare laws and regulations, including those governing nursing homes and rehabilitation facilities.
· Exceptional written and verbal communication skills, with the ability to explain complex legal concepts to non-legal professionals.
· Strong interpersonal skills and the ability to collaborate across diverse teams.
· High level of integrity, discretion, and sound judgment.
Preferred Skills:
· Familiarity with risk management tools and software.
· Experience working in multi-facility organizations or with corporate healthcare systems.
· Demonstrated ability to handle high-stress situations and competing priorities effectively.
Work Environment: This is an on-site role that requires regular travel to facilities and frequent appearances in court. The ideal candidate will have a hands-on approach and be comfortable engaging directly with operational staff, residents, and families when addressing legal matters.
Pay is 200k.
