Position Summary & Responsibilities
Position Summary:
The incumbent will work directly with prospective or existing providers to obtain information and assess their capability and readiness to service HCBS participants along with the review of evidence submitted to support responses provided through the final rule assessment. They will follow federal regulations, state regulations and state policy to make determinations on provider setting compliance. They will address areas of non-compliance and work with the provider to guide them on the submission of appropriate evidence to meet compliance requirements with the HCBS Settings Final Rule. They will offer technical support and one-on-one assistance for the service setting to gain compliance. They will pre-screen settings flagged for isolating characteristics and conduct virtual or onsite assessments to assess a provider and the setting’s ability to overcome presumptions of isolation and/or institutional characteristics.
Job Responsibilities may include but are not limited to the following:
Compliance Verification
- The incumbent will be responsible for completing the initial desk review for each submitted self-assessment by reviewing submitted evidence for the minimum requirements to be considered official. The incumbent will deliver a compliance determination for each question following federal regulations, state regulations and state policy.
- The incumbent will identify each area of non-compliance by flag issues and defects in provider submitted evidence sources of policies, manuals, processes and procedures documentation while directing providers to appropriate remediation strategies and resources if such submissions are inappropriate.
- The incumbent will process information from various sources following standard policies and procedures to support the compliance determination process. The sources could include, but will not be limited to the following: o Google mapping and additional sources accessible through the internet.
- The incumbent will provide one-on-one technical assistance as needed to providers in need of such help for them throughout the process of becoming compliant with the HCBS Settings Final Rule, including directing them to other resource and training guides.
- The incumbent will engage with providers to identify training needs and direct them to available training resources in the state.
- The incumbent will be responsible for conducting on-site assessments of HCBS settings or sites that have been identified as having the qualities which create the presumptions of institutionalization (settings or sites attached to, on the ground of or adjacent to an institution).
- The incumbent will be responsible for completing summary reports documenting the visit, gathering evidence, and adjudicating the setting or site for compliance or capability to overcome the presumptions of institutionalization.
Quality Management
- The incumbent will be responsible for independently managing and overseeing a caseload of providers by ensuring providers are actively engaged in compliance activities, proactively offering assistance, monitoring the settings’ final compliance status through the desk review and remediation efforts, assisting providers with the Screening II assessment and the completion of the summary packet, and tracking provider recertification and changes to the providers service delivery model which may necessitate additional compliance activities on behalf of the provider.

The incumbent is responsible for the tracking of any changes that may impact a provider’s compliance status, including changes related to:
- Services provided;
- The service delivery method;
- Identification of isolating characteristics;
- Geographical location changes

The incumbent will receive Settings Rule concerns and complaints from various avenues and will conduct adequate follow up through mechanisms that may include but are not limited to: provider documentation and individual PCSP review, onsite visits, written communication, and/or interviews with HCBS participants and provider staff.
- The incumbent will identify any specific compliance concerns and work with the HCBS provider to ensure services are provided in a person-centered manner and to avoid potential disruption in services.
- The incumbent will be required to conduct regular on-site visits as outlined by KDADS internal procedures to assess the settings' adherence with the HCBS Settings Rule. These visits will include HCBS participant interviews, staff interviews, assessment of the setting's integration with the surrounding community and those that do not receive HCBS, rights and choices of participants served and their autonomy and independence capabilities.
Provider Engagement
- The incumbent will serve as a Subject Matter Expert related to the Home and Community Based Final Settings Rule.
- The incumbent will be responsible to initiate outreach to establish and support consistent communication with prospective or existing providers which shall include but not limited to:
- Outreach to providers billing HCBS that have not created an account in the HCBS Compliance Portal
- Educate providers of available resources and informational documents.
- Offer 1:1 supports by educating providers about Final Rule, the compliance process and how to navigate the portal.
- Provide encouragement and/or offer individual supports regularly to promote provider engagement
- Frequently monitor provider contacts and take appropriate steps when updates are required.
- Monitor outreach from providers and respond timely to assist them throughout the compliance process
- Keep providers informed of their settings status and of the potential of heightened scrutiny
- Solicit provider responses to the applicable pre-screening questions.
- Scheduling and completion of Screening II assessments to include the completion and upload of assessment documents, preparing summaries, and completing remediation documentation if required and request posting for final review and determinations of compliance
- The incumbent will obtain information from HCBS prospective or existing providers to assess their capability and readiness to service HCBS participant programs and services. They will assist the prospective or existing providers in entering their settings into the HCBS Compliance Portal and beginning the Screening I process.
Completes special projects and performs other duties as assigned including but not limited to ensuring the agency is adequately staffed during and immediately following natural and/or manmade disasters, infectious disease outbreaks, and/or acts of terrorism. Assists other employees in the work unit in accomplishing assignments as necessary.
Qualifications
- One year of experience interacting with clients and customers in a public, in a social service, customer service or a problem resolution setting. Education may be substituted for experience as determined relevant by the agency.
- Associate degree in health or human services, a behavioral science field of study or education in an area determined relevant by the agency.
- Knowledge of the Kansas Medicaid program
- Unrestricted Driver’s License- Incumbent is required to have and maintain a valid driver’s license when operating a state vehicle, a private vehicle or a rental vehicle for the benefit of the State.
- Knowledge in computer software including word processing, spreadsheets and data bases is preferred.
- Proofreading and editing attention to detail
- Knowledge and use of Microsoft software: Outlook, Word, Excel, PowerPoint and Access
- Minimum of a year experience in or willingness to learn KanCare Medicaid Programs
