This position offers a Trainee Status* at the following pay rate: $30.02 per hour.

The State of New Hampshire, Department of Labor, Legal Services has a full-time vacancy for an Attorney II.

Summary:
Provides legal representation, interpretation and counsel regarding state statutes, regulations, legislation and litigation on behalf of the Department of Labor. Oversees the development of informed and sound policies and training for Department staff to support Department initiatives. Reports to General Counsel.

YOUR EXPERIENCE COUNTS : Each additional year of approved formal education may be substituted for one year of required work experience and/or each additional year of approved work experience may be substituted for one year of required formal education.

MINIMUM QUALIFICATIONS:
Education: Juris Doctorate from an American Bar Association recognized law school.
Experience: Four years of experience in the active practice of law.
License/Certification: Valid driver’s license and/or access to transportation for statewide travel.
SPECIAL QUALIFICATIONS: Must be an active member of the New Hampshire Bar Association and in Good Standing.
RECOMMENDED WORK TRAITS: Knowledge of pertinent laws of trial, legal procedures, and methods of legal research. Ability to prepare legal cases and briefs and to represent an agency in court proceedings. Ability to render effective decisions and deal tactfully with the courts, local enforcement officials, state department heads and the public. Must be willing to maintain appearance appropriate to assigned duties and responsibilities as determined by the agency appointing authority.

Responsibilities:
  • Assists Departmental staff through the administrative rulemaking process for Workers’ Compensation, Wage and Hour, Managed care, Self-Insurance and any new legislation that requires new regulations.
  • Render official opinions on state statutes pertaining to the Department of Labor as well as legal interpretations of all agency rules and regulations.
  • Conduct legal research to provide analysis and counsel concerning legal issues involving the Department of Labor.
  • Draft and evaluate pending legislation and counsel the Department of Labor regarding impact of legislative changes.
  • Plan legal seminars for town and city officials as well as employers to explain changes in state statutes.
  • Prepare cases and appear in court action involving cases arising in the conduct of Department of Labor affairs.
  • Coordinates and prepares Departmental responses to requests for information under state law.
  • Monitors proposed legislation to ascertain impact on Labor Laws; provides testimony before the legislature on proposed legislation that affects Departmental regulation or operation; responds to legislature for additional research and reports.
  • Provides functional oversight and supervision to legal unit staff related to court and collection activities involving regulatory objectives of the Department.
  • Prepares legal papers and memoranda for coordination of state and federal agencies.
