The pay range for this position is $37.22 - $51.07 per hour

The State of New Hampshire, Department of Safety, Office of the Commissioner has a full-time vacancy for Hearings Examiner, SOC Title 23-1020 ADMIN LAW JUDGES-6. This position has a 37.5 hour work week and is considered exempt. This is a grant funded position and subject to renewal every 2 years.

SUMMARY: To provide case prosecution and legal assistance to Division of State Police, Division of Motor Vehicles, Marine Patrol and State Hospital Campus Police on DWI/OUI alcohol/drug related cases throughout the state.


YOUR EXPERIENCE COUNTS: Each additional year of approved formal education may be substituted for one year of required work experience and/or each additional year of approved work experience may be substituted for one year of required formal education.

MINIMUM QUALIFICATIONS:

Education: J.D. from a recognized law school.

Experience: Five years' experience as an attorney, two years of which must have been as an attorney involved with administrative law or concerned with regulatory authorities.

License/Certification: Must possess a valid driver’s license.


SPECIAL REQUIREMENTS:

1. Must be an active member of the New Hampshire Bar Association and in Good Standing.

2. Selected candidate will undergo a fingerprint-based criminal background check and motor vehicle record check in order to ensure suitability for exposure to confidential information.


RESPONSIBILITIES:

Reviews DWI alcohol/drug arrest and DWI related case reports on court cases brought by State Police and other Department of Safety Law Enforcement personnel and makes decisions as to whether or not a case is prosecutable under applicable law and in accordance with the New Hampshire Rules of Professional Conduct.

Conducts pretrial meetings with defense attorneys regarding stipulations and negotiated pleas on DWI/alcohol related motor vehicle cases.

Responds to defense motions and prepares motions on behalf of the State on DWI/alcohol/drug related cases.

Represents the State for motion hearings, preliminary hearings and trials on DWI/alcohol/drug related cases. Prepares case files, sends discovery, and files pre and post-trial motions.

Subpoenas and cancels witnesses and prepares and prosecutes cases before the Circuit Courts statewide on DWI/alcohol/drug related cases.

Evaluates DWI/alcohol/drug related court decisions to determine impact on the department's law enforcement efforts and prepare educational materials regarding such decisions.

Explains complex policies, rules, and statutes to inquiring parties including law enforcement agencies, attorneys and members of the public on DWI/alcohol related cases.

Conducts legal training on DWI and related matters for State Police and other DOS law enforcement agencies.

Collaborates with the Bureau’s Chief Paralegal to supervise the assigned paralegal’s work products and monitor performance to ensure consistency with established guidelines, to complete annual evaluations and to develop and implement corrective action plans, if needed.
