When a benefitted employee resigns, they must wait at least 26 weeks before they can return to work for WCPS in a non-benefitted position. Non-benefitted positions include contractual employment and substitute teaching. When a benefitted employee resigns, they must resign from all WCPS positions for the 26 week break in service period.
If an employee retires and elects WCPS Retiree Health Insurance then the 26 week break in service rule does not apply.
If an employee retires and does not elect WCPS Retiree Health Insurance then the retiree has to wait 26 weeks from the date their WCPS health insurance coverage ended before they can begin working as a contractual or sub.
This rule was implemented in 2013 as a result of the Affordable Care Act (ACA).
