The Compliance Advisor’s primary responsibility is to provide compliance guidance on employee benefits issues, focusing on the Employee Retirement Income Security Act (ERISA), health and welfare benefits, executive benefits, and retirement plans. Work closely with the company's internal stakeholders, including sales and service teams and divisional leadership to ensure the firm’s clients are receiving benefits offerings that comply with all applicable federal and state laws and regulations.

Essential Job Functions :

  • Provide expert legal counsel on ERISA-related matters to ensure compliance with federal regulations governing employee benefit plans, including health, welfare, and retirement plans.
  • Interpret ERISA, ACA, HIPAA, COBRA, and other federal statutes to advise on compliance obligations, best practices, and the development of benefits products.
  • Draft, review, and analyze legal documents related to benefit plans, such as SPDs, plan documents, trust agreements, service provider contracts, and insurance products.
  • Advise on fiduciary responsibilities, participant rights, regulatory filings (e.g., Form 5500), and plan audits while ensuring proper management of plan assets and governance practices.
  • Stay abreast of regulatory changes, case law, and proposed legislation, providing proactive advice and guidance to internal teams and leadership on compliance and risk mitigation.
  • Support corporate transactions, such as mergers and acquisitions, by addressing employee benefit plan issues and ensuring regulatory compliance during transitions.
  • Provide training and educational resources to internal teams on ERISA compliance, benefits administration, and related legal matters, while communicating updates through bulletins, newsletters, and client engagements.
  • Assist in resolving ERISA-related disputes, including claims denial, eligibility issues, and benefits administration, while identifying and mitigating litigation risks.
  • Collaborate with departments such as HR, Compliance, and Finance on employee benefit plan design, implementation, and ongoing management.
  • Develop internal policies and procedures to ensure compliance with ERISA, tax laws, and other applicable regulations, and support additional duties as needed.
  • Credentials : Required :

  • Juris Doctor (JD) degree from an accredited law school.
  • Admission to the bar in Iowa (or ability to obtain admission if licensed in another jurisdiction).
  • Minimum of 5 years of experience practicing law with a focus on ERISA, employee benefits, insurance law, or a related field.
  • In-depth knowledge of ERISA, the Internal Revenue Code (IRC), HIPAA, the Affordable Care Act (ACA), COBRA, and other applicable federal and state regulations governing employee benefits.
  • Strong understanding of health and welfare benefits, executive benefits, retirement plans, and insurance products.
  • Experience working with complex benefits issues, including plan design, administration, compliance, and litigation.
  • Proven ability to analyze legal issues, communicate risks, and provide strategic legal counsel.
  • Preferred :

  • Experience working in-house at an insurance company, third-party administrator, or insurance agency / brokerage.
  • Familiarity with multi-state benefits regulations and reporting requirements.
  • Previous experience managing or litigating ERISA-related claims or disputes.
  • Knowledge of the insurance industry.
