Real Estate Closing Attorney - Summary:
We are seeking a highly skilled and experienced Real Estate Closing Attorney for business purpose loans to join one of our amazing real estate partners to be based in their newly created Westport, Connecticut office. They are a fully funded direct private lender with offices in Manhattan and Miami, specializing in providing business-purpose mortgage loans for non-owner-occupied investment properties. The successful candidate will play a crucial role in creating and reviewing legal documents to support a growing originations business.
Real Estate Closing Attorney - Responsibilities:
- Represent Company in the origination of mortgage loans, including managing legal components of loan closings
- Draft, negotiate, and analyze contracts, mortgages, purchase and sale agreements, leases, organizational documents, loan documents and related agreements
- Prepare and review all aspects of due diligence, title and survey, and joint venture agreements
- Oversee and manage all aspects of complex business purpose lending real estate closing transactions for Residential Transitional Products- Fix & Flip, and Bridge loans, DSCR/ 30-year loans, Ground up Construction, Small Balance Multi-Family
- Handle real estate transactions involving business entities, such as corporations, LLCs, partnerships, and trusts
- Conduct thorough due diligence investigations, including title searches, zoning reviews, environmental assessments, and lien searches
- Ensure compliance with all applicable federal, state, and local laws and regulations related to real estate transactions
- Create Loan Closing packages with all necessary documents for closing business purpose mortgage lending transactions in a high volume, scalable, technology-based environment
- Coordinate with Processing, Underwriting and Closing teams, Loan Advisors, Clients, Brokers, and Title Companies to facilitate a smooth closing process
- Identify and resolve legal and contractual issues that arise during the closing process
- Perform due diligence on loan files during the closing process and ensure files are completed post-closing
- Create and review legal documents for closings: review mortgages, title, liens, judgments, contracts, entity documents, agreements
- Maintain accurate and up-to-date records of all transactions and contracts
Real Estate Closing Attorney - Qualifications:
- Juris Doctor (JD) degree from an accredited law school
- Proven experience in the mortgage industry, specifically in loan closings
- Experience working with a title company/ or title insurance company, lending platform, and or law firm is ideal; ability to clear title
- Strong working knowledge of commercial loan transactional documents, commercial loan structures/terms
- Attention to process and detail, recalculations of fees, etc.
- Take ownership of closing pipeline, CRM, and generate timely and accurate reporting, work without direct supervision
- Must be self-motivated and enthusiastic to achieve company goals
- Ability to stay organized to easily retrieve information and documents as needed
- Flexibility to adapt to peak periods of heavy workload and pressure
- Maintain a professional image and standards consistent with Company policies and procedures
