UNICO is seeking a motivated, self-starter to fill our Labor Compliance Specialist opening. This position will assist the Construction Management division with administering its Labor Compliance Program. As a full-service CM firm UNICO interfaces with agency staff, prime contractors, and sub-contractors. The ideal prospect for this position will have knowledge of federal and state prevailing wage requirements on public works projects and prior experience with public works labor compliance. This experience should include but not be limited to, a firm working knowledge of the following topics and forms, prevailing wage, Department of Industrial Relations (DIR), Davis-Bacon Act, Contract Award information DAS-140, Registered Apprentice Program DAS-142, Training Fund Contributions monitoring CAC-s, Fringe Benefits Statements, Payroll Reporting (CPR’s), Verifying Statements of Compliance CEM-2503, Issuing Statements of Non-performance, and DBE Tracking.
Role Description
This position will be a multi-faceted role. In addition to external contract requirements, the Labor Compliance specialist will also maintain and manage the internal company payroll along with the labor compliance reporting and prevailing wage reporting for public works projects.
This position will be responsible for establishing, streamlining, and maintaining compliance with department policies, procedures, and risk management controls.
Labor Compliance Responsibilities
- Collect, track, and review certified payroll compliance paperwork from contractors and sub-contractors via hard copy and web-based applications including pay rates, fringe benefit statements, employer training contributions, apprenticeship paperwork, certified payroll records, review for reasonableness, correctness and compliance with applicable rules and regulations.
- Collect and/or perform on-site in-person interviews for labor compliance and posting in coordination with inspector or construction management staff.
- Review public works contracts to determine additional labor compliance requirements.
- Sends correspondence for missing documents and request revised documentation with the applicable contractors’ staff to ensure compliance.
- Actively support operational goals and objectives through reviewing current labor laws and complying with owner/agency’s labor compliance requirements, actively managing risk associated with certified payroll requirements and proactively resolving challenges and issues as they pertain to project specific Labor Compliance.
- Monitor DIR wage determinations for rate/fringe changes.
- Gather feedback and continuously make improvements to work processes and practices.
- Review current state and federal labor laws pertaining to Prevailing Wage requirements.
- Conduct labor compliance training classes/seminars for stakeholders, program employees, and contractors
- Coordinate with project inspector and/or CM team for EEO interviews
- Maintain and upload all UNICO required certified payroll
Internal Payroll Specialist Responsibilities
- Set new employees up in time tracking software (Unanet) and payroll processing software (Paylocity) and maintain and update current employees’ information. This includes setting up earnings codes, tax schedules, deductions (i.e., health insurance premiums, 401K contributions, wage garnishments, etc.), vehicle allowances, cell phone reimbursement, direct deposit, and PTO accrual rates.
- Work with the HR Director for the on-boarding, promotion, or discharge of employees, as necessary.
- Process bi-weekly payroll that includes Prevailing Wage hours on public works projects.
- Track Payroll Change forms and make appropriate updates to employee payroll records.
- Track and record PTO requests, confirming that employees have accrued appropriate number of PTO hours.
- Calculate and report training fund contributions for UNICO.
Requirements
- 3 – 4 years prior experience processing prevailing wage payroll, analysis, and auditing skills, DIR reporting, reporting classifications or specialized payroll reporting (i.e., Davis Bacon Act)
- Knowledge of employment practices in the construction industry and a strong working knowledge of state/federal labor regulations
- Familiarity with Caltrans Local Assistance Procedure Manual (LAPM) preferred.
- Experience working with public works labor compliance programs preferred.
- Excellent verbal and written communication skills
- May require travel to project sites throughout California
- Excellent organizational skills and attention to detail
- Knowledge of general financial accounting and cost accounting
- Ability to adhere to generally accepted accounting principles (GAAP)
- Proficient with Microsoft Office Suite (Excel) and accounting software
