RISK AND SAFETY DIRECTOR
JOB PURPOSE: Responsible for overseeing the Risk Management department, litigation and claims management processes, and ensuring compliance with regulatory requirements for company insurance programs. Oversee the design and implementation of key safety and loss control programs, identification and assessment of risks and loss trends. Assist with the design, procurement, and administration of company insurance programs and with monthly financial close.
KEY RESPONSIBILITIES:
- Coordinate activities of risk management department with internal and external partners including Legal, Human Resources, Operations, Internal Audit, insurance brokers, consultants, TPA's and insurers to ensure effectiveness of company's risk management programs.
- Provide oversight of claims and litigation for which company has self-insured retentions or insurance coverage, in partnership with Legal and other operating units, including development of insurance coverage schedules, policies and procedures, performance standards, claim reviews and audits.
- Supervise all liability claim reviews and audits to ensure effective claims handling by internal and/or external adjusters.
- Authorize claim reserves and settlements within established authority.
- Manage external vendors in the areas of claims management through benchmarking, loss analysis, establish and continuous measurement of key performance indicator (KPI) reports to ensure adherence to best practices as well as company specific claim program goals, directives, initiatives, policies, and procedures.
- Provide contract and lease review support to business units and internal departments in the evaluation of insurance terms, support due diligence of acquisitions and dispositions, new business strategies, and other transactions which impact the risk profile for the Company.
- Oversee all aspects of Insurance programs for all geographies, including WC coverage in monopolistic states, ensuring that exposure information is gathered, supporting applications, and review of coverage options for all geographies, understand policies, limits, and endorsements as it relates to risk and on-going claims management.
- Provides direction and support for catastrophic and high exposure incidents involving Company coworkers, vehicles, and other property. Provide timely updates to Upbound Legal and Executive Management.
- Oversee all aspects of Actuarial process, including timely gathering of information, review and reconciliation of liability claims related data to third party provider.
- Responsible for identifying safety opportunities within operations and aligning with internal departments, such as training, to put in place actions that prevent and mitigate future losses based on analysis of loss information and trends, driving reductions in claim frequency and severity trends.
- Ensure support and alignment with Legal regarding new and on-going AL/GL claim litigation.
- Supervise staff members and provide guidance and support for professional development.

JOB REQUIREMENTS:
- BA degree in business administration, finance, or risk management, with CPCU, CRM, ARM professional certifications highly preferred.
- 15 years progressive experience handling multistate claims and complex litigation matters.
- Strong negotiations skills and mediation experience.
- Ten or more years of supervisory experience.
- Thorough and proven knowledge of standards, practices, procedures, and various laws applicable to claims adjusting.
- Direct experience managing TPAs and insurance policies.
- Must be collaborative, persuasive, and able to work with a range of executives and managers across internal departments and business units within the organization including external vendors such as brokers, carriers, TPA's, and legal counsel.
- Must be analytical, strategic, creative, versatile, flexible, hands-on and responsive.
- Strong computer skills including Excel, Word, Outlook and Access.
- Excellent written and verbal communication skills.
- Must be able to manage and shift priorities and multi-task to meet critical deadlines and goals; successful in a dynamic environment where issues and opportunities arise with short or notice.
- Ability to analyze various types of data and produce reports for management.
- MUST be able to work in office (Plano, TX) Monday through Friday
