Description : Summary :
Plan, organize, direct, and control the activities and staff of the Special Accounts Department. Minimize
losses incurred by the Credit Union’s loan portfolio, while following all applicable laws, policies, and
procedures.
Essential Duties and Responsibilities :
- Ensure the smooth and effective day-to-day operations of the Special Accounts Department.
- Ability to communicate effectively to promote efficient and correct workflows, establish positive working relationships across the Credit Union.
- Manage and ensure on-going training of staff in the Special Accounts Department. Responsible for establishing and documenting performance thresholds and collection Service Level Agreements. Conduct performance reviews, recommend salary adjustments, and counsel staff toward optimum performance.
- Provide for the contact of members with delinquent loans for the purpose of obtaining delinquent payments, arranging for payment schedule to bring loan current, rescheduling existing payments or determining member’s present status in order to make provisions for obtaining outstanding balance. Effectively work and oversee work performed on all collection queues to ensure timely contact is madewith members. Utilize all collection tools available to secure repayment of the loan. Responsible for determining if members have Debt Protection Insurance and work with members to determine qualifications and to encourage members to file necessary claims to minimize losses to the Credit Union.
- Responsible for working with collection attorneys and collection agencies to ensure maximum recoveries of Credit Union losses including monthly monitoring and appropriate documentation. Responsible for ensuring collection attorneys and collection agencies are following Federal and State regulations.
- Responsible for utilizing all legal remedies available to obtain payment of any amounts owed. These remedies can include seeking legal judgment against the borrower to execute a judgement against wages, cash assets held in a bank, consumer goods such as automobiles, and real property or personal items. Use of legal actions should provide a positive return and cannot expose the Credit Union to additional risk or liability.
- Administer the repossession of collateral securing delinquent loans and provide for the deposition of repossessed property as provided by law. Recommend to VP / Chief Lending Officer, vehicles to be repossessed. Work with repossession vendors and collateral protection insurance (CPI) vendor to obtain the maximum recovery on each vehicle.
- Initiate and represent the Credit Union in legal matters at Small Claims Court and work with outside counsel for matters heard in municipal court. File all paperwork required by the court system to attain a court hearing. Responsible for follow through and tracking on all cases sent to any court. Review all bankrupt accounts for possible action. Manage the review of bankruptcy schedules, the filing of reaffirmation and proofs of claim, and attend the 341-bankruptcy hearing if warranted.
- Prepare and present to the Board of Directors, requests for loans to be charged-off or loans deemed to be uncollectable. Assign charged-off accounts to attorney or collection agency for appropriate action. Advise credit reporting agencies of accounts with derogatory information. Maintain control of chargedoff accounts, reviewing for further recovery. Maintain ledger of recovered funds collected on chargedoff accounts, insuring proper crediting to each account.
- Responsible for managing all delinquent real estate loans. Initiate foreclosure proceedings on delinquent loans secured by first or second trust deeds.
- Responsible for collection of returned deposited items or NSF checks, which may result in a loss to the Credit Union.
- Responsible to ensure the collection policies, procedures, services, products, and documentation meet federal and state regulations.
- Register with the Nationwide Mortgage Licensing System and Registry (NMLS) and State of California Department of Insurance. Required to undergo a background check. Registration with the NMLS to be maintained on an annual basis.
- Other duties as assigned.
