Woods Rogers seeks a Labor and Employment Attorney to join its Charlottesville office. The Labor and Employment Attorney specializes in handling legal matters related to employment law, labor unions, workplace disputes, employee rights, and employer obligations. The role involves providing legal counsel to both employers and employees on a variety of issues, including discrimination, harassment, wage disputes, wrongful termination, collective bargaining, and compliance with labor laws and regulations.
Required Qualifications
Juris Doctor (JD) degree.
Admission to the state bar of Virginia.
Minimum of three (3) years of experience in labor and employment law.
In-depth understanding of labor and employment laws, including federal and state regulations (e.g., FLSA, FMLA, ADA, Title VII, NLRA).
Familiarity with workplace compliance issues and employee relations.
Experience in litigation and alternative dispute resolution processes.
Knowledge of collective bargaining and union-related matters is a plus.
Strong research, analytical, and problem-solving skills.
Excellent written and oral communication skills.
Ability to build relationships with clients and stakeholders.
Effective negotiation and advocacy skills.
Ability to manage multiple cases and priorities.
Responsibilities
Advise clients on matters related to labor and employment law, including workplace disputes, wage and hour issues, discrimination, harassment, wrongful termination, and other employment-related matters.
Represent clients in litigation, including before federal and state courts, administrative agencies (such as the Equal Employment Opportunity Commission or the Department of Labor), and in arbitrations or mediations.
Assist clients in navigating and ensuring compliance with federal, state, and local labor laws (such as the Fair Labor Standards Act, Family and Medical Leave Act, Title VII of the Civil Rights Act, etc.).
Review and draft workplace policies, employee handbooks, employment contracts, non-compete agreements, and other relevant documents.
Conduct workplace investigations related to complaints of discrimination, harassment, retaliation, and other employment-related issues.
Represent employers or labor unions in collective bargaining negotiations.
Draft and review union contracts, manage labor disputes, and advise on grievance procedures.
Handle employment-related lawsuits, including claims of discrimination, wrongful termination, wage and hour violations, and labor violations.
Represent clients in alternative dispute resolution processes, such as arbitration or mediation.
Prepare legal documents, including pleadings, motions, discovery requests, and settlement agreements.
Provide training to employers and employees on topics such as sexual harassment prevention, employee rights, workplace safety, and discrimination.
