THE COMPANY:
We are working with a long standing client of ours who are looking for a CCO & MLRO to join the team in Frankfurt. The client are a overseas corporate bank and are looking for a candidate who has great knowledge and working experience with BaFin.
THE RESPONSIBILITIES:
As Head of Compliance and AML departments the acts independently and reports directly to the Senior Management Board (SMB) of the Branch for all matters relating to compliance/AML aspects within the Branch and maintain a sound and adequate compliance function;
Provide Compliance Report and AML Report to the SMB and the Head Office periodically (monthly and quarterly);
Assess, analyse and report promptly for any important bank sector compliance-related notices or regulatory changes, and any frauds, enforcement actions from regulators, breaches of regulations or other significant incidents to the SMB and the Head Office;
Provide advice and support to the all business and operation areas of the Branch, to promote compliance with German/European regulatory the Head Office’s requirements;
Undertake or assist with team processes and ad hoc project work, providing analysis and making recommendations, (including the review or processing of alerts), as required;
Based on German AML Act (GwG), CCO as the AML Officer of the Branch, and he is central contact person for the law enforcement authorities, the Federal Office for Economic Affairs and Export Control (Bundesamt für Wirtschaft und Ausfuhrkontrolle), the German Financial Intelligence Unit and BaFin. Her/his name will be registered to BaFin and Bundesbank;
Conduct compliance, AML/CTF risk assessment to record, identify, categories and evaluate the risks that exist within the Branch;
Develop, update and implement internal policies and procedures for AML/CTF measures;
Further investigate the AML/CTF suspicious alerts/cases escalated by the Compliance Assistant;
Reporting under Money Laundering Act Sec. 43 (1) or Information Request;
Identify training needs for new staffs and existing staffs within input to the training plan for the Branch. Develop training materials and carry out compliance, AML/CTF trainings in line with plan;
Ensure that all staffs receive sufficient compliance, AML/CTF trainings as required according to schedule;
Monitor any new or changed regulatory requirements and assess of their impact on the Branch and update relevant documents or measurements, and provide guidance accordingly;
Review and verify to ensure the Branch’s Polices & Procedures and all corporate documents are well maintained and updated, according to the German regulatory and Head Office’s requirements;
Act as the whistleblowing function, analyzing the whistleblowing complaints and take further steps when necessary;
Besides, act as Complaints Handling Officer, coordinate the Branch’s complaints handling processes to ensure they comply with standards and guidance.
EXPERIENCE REQUIRED:
5 years experience within a corporate bank within the compliance space.
Experience of speaking and dealing with the regulator
Fluency in German & English is a must.
Ability to commute to the office full time.
August start date – 2 year fixed term contract, then decision to be made permanent if both parties accept.
