What are the responsibilities and job description for the Filter Attorney / Law Clerk position at Ardelle Associates?
Ardelle Associates is seeking Filter / Privilege Review Attorneys to support the Department of Justice (DOJ) U.S. Attorney's Office (USAO) in Newark, NJ.
The filter attorneys will work with filter agents, defense counsel, and the Court to determine what documents are not privileged, privileged, and / or subject to a privilege exception. The filter attorneys will turn over any evidence determined to be not privileged, subject to a privilege exception, or over which the privilege has been waived to members of the prosecution team. The filter attorneys will destroy any evidence determined to be privileged at the end of the filter review.
The Filter Attorneys will be responsible for directly and independently supporting pending investigations and cases by performing the following tasks :
1) Document management and review, searches within various data and document sets, analyzing and summarizing various data and document sets.
2) Assisting with interviews of potential witnesses to assist in preparation for charging or trial. Review, summarize and outline grand jury, deposition, and trial testimony to assist in preparation for charging or trial.
3) Research, analyze and summarize relevant legal precedents for applicability to assigned cases; and prepare digests of points of law involved; analyze appellate records to isolate facts pertinent to distinct legal issues. Utilize a variety of automated legal research tools as well as public information databases and other automated resources to research factual and / or legal matters related to cases or programs, and to participate in electronic discovery and other assigned areas of criminal proceedings.
4) Review investigative reports to determine the need for additional information and evidence, and plan a comprehensive approach to obtaining required information and evidence.
5) Conduct related research and draft and prepare legal proceedings necessary to commence criminal cases, subsequent motions, orders, plea documentation and other pleadings.
6) Perform a variety of tasks associated with all facets of case preparation and provide trial support by performing one or more of the following :
- Briefings prior to hearings by reviewing pertinent facts, issues, and case law.
- Assist in pretrial preparation by preparing, reviewing, summarizing, organizing, and produce voluminous discovery; notify, interview, and manage witnesses; and research case law.
- Receive transcripts of depositions, hearings and grand jury proceedings and prepare summaries to assist.
- Prepare presentations for court proceedings by reviewing, compiling, organizing, and indexing evidentiary exhibits through the use of software such as Excel, PowerPoint, and Trial Director.
7) Work with members of the filter team to review evidence seized
8) Work with the Court to resolve disputes regarding privilege determinations which may require the filing of motions or other pleadings.
Communication skills are extremely important . The ability to work as a team member and to facilitate work processes among other staff members is necessary. Ability to meet established deadlines and work as a team player in a professional office setting is also required. The position requires meeting and dealing with people in a courteous and tactful manner.
Applicants must have the ability to use MS Excel, MS Outlook, MS Word, MS Powerpoint, Adobe Acrobat Professional, and have experience reviewing documents and working with document review platforms such as CaseMap, Eclipse, IPro, Relativity, and Trial Director.
