What are the responsibilities and job description for the Chief Legal Officer position at B.E. Lending?
We are seeking an experienced Chief Legal Officer with 5-10 years of expertise in real estate transactions to join our Phoenix office. This role is pivotal in drafting, reviewing, and advising on a diverse array of documentation, ensuring compliance with lending/fund regulations across all 50 states, and providing experience and insight on transaction structure and form. The ideal candidate will work in close relations with company leadership to ensure adherence, accuracy and completion of all legal matters.
Key Responsibilities
- Draft, review, and provide legal opinions on critical documents, including: Promissory Notes, Deeds of Trust, Operating Agreements, Guaranties, Collateral Pledges, Forbearance Agreements, Residential and Commercial Leases/Purchase Contracts, Loan Agreements and others.
- Support all BE Lending transactions by ensuring legal accuracy, regulatory compliance, and risk management.
- Maintain adherence to federal and state fund management regulations, lending laws, filings and reporting requirements across all 50 states.
- Collaborate directly with external legal experts to resolve complex issues and execute tasks efficiently.
- Present legal analyses, risks, and recommendations to BE Lending’s management in a concise, straightforward manner.
Qualifications
- Juris Doctor (JD) degree from an accredited law school and active bar membership in good standing (Arizona bar required).
- 5-10 years of legal experience with a strong emphasis on real estate transactions and structuring, ideally in private or bridge lending.
- Comprehensive understanding of lending practices, real estate law, and multi-jurisdictional compliance (expertise spanning all 50 states is a plus).
- Proven ability to draft and analyze complex legal documents with precision and efficiency.
- Strong collaboration skills to work seamlessly with outside counsel and internal stakeholders.
- Exceptional communication skills, capable of simplifying intricate legal concepts for non-legal audiences.
- Detail-oriented, proactive, and able to manage multiple priorities in a fast-paced, growth-driven environment.
