BOLI has an opening for one Administrative Prosecutor (Compliance Specialist 3) position in the Commissioner’s Office. This position will be based in either our Portland, s office. The successful candidate may also be eligible to work a hybrid schedule.
This is a permanent, full-time, SEIU represented position. This recruitment may be used to fill additional vacancies as they occur.

What You Will Be Doing
Below is a sampling of job duties. It is not meant to encompass all duties.
As an Administrative Prosecutor, you will evaluate, prepare, and settle or present Civil Rights Division, Wage and Hour Division, Prevailing Wage Rate Unit, and Apprenticeship and Training Division cases at contested case hearings. Case presentation requires a basic working knowledge of the evidence code and the Administrative Procedures Act, as well as the specialized areas of law within BOLI’s jurisdiction, and the work routinely involves motion practice and can involve extensive motion practice and discovery disputes. You will also be responsible for negotiating settlements and preparing settlement documents for approval of the division administrators and filing with the administrative forum.
You may work on matters that generate high-profile interest, public scrutiny, broad impact and/or media attention. Advanced levels of professionalism, discernment, ethical conduct, and thoughtful, proactive communication are required.

Working Conditions:
Office environment. Occasional exposure to hostile members of the public. Occasional in-state, overnight travel. Administrative Prosecutors create and finalize written product on laptop computers.
This Is What You Need to Qualify:
  • Five years of experience doing administrative research that includes compiling and evaluating facts to recommend management action, or decide compliance or eligibility with program guidelines and regulations. Three of the five years must be above the technical support level.
College-level course work may substitute for experience on the basis of 45-quarter units per year, up to a maximum of three years
Required Skills:
  • Graduation from an accredited law school with an LL.B. or J.D. degree AND
  • One year of experience preparing and presenting evidence and argument in formal, quasi-judicial administrative hearings of considerable or unusual difficulty involving multiple, complex issues with significant social, economic, financial or public policy impact, or in court as a trial attorney.
The ideal candidate will possess the following desired skills and attributes:
  • Ability to prepare and effectively present evidence and arguments in formal, quasi-judicial administrative hearings of considerable or unusual difficulty.
  • Skilled at navigating a complex and sensitive legal framework that has social, economic, financial, or public policy impact.
  • Familiarity and comfort conducting in-depth, exhaustive legal research regarding legal issues in employment and civil rights matters without precedent or that involve vague statutes and present highly complex and sensitive issues.
  • Ability to organize, calendar and execute litigation strategy over the course of many months.
  • Training and experience serving diverse individuals and communities.
  • Training and experience serving victims of crime or other violations of law such as civil rights plaintiffs, or other plaintiffs.
  • Superior writing skills with a focus on accuracy and citation of proper precedents and applicable statutes/legal sources.
  • Ability to correctly and promptly examine and analyze a considerable amount of conflicting, technical information, evidence, testimony, and to exhibit and develop a clear understanding of the issues and facts of a contested case.
  • Experienced working successfully with several attorneys and staff on complex matters, exhibiting a high degree of cooperation, good listening skills, litigation acumen, confidentiality and discretion, together with a solutions-oriented approach to prosecuting cases.
  • Individuals with professional competencies in Spanish, Russian, or Vietnamese are strongly encouraged to apply.
