Under supervision of the Municipal Court Administrator, the Prosecution Clerk performs varied legal clerical work in the prosecution division of Pittsburg Municipal Court. This position involves considerable public contact, processing, filing, and reporting of case file information, issuing subpoenas, preparing prosecution records and dockets. This position requires in-depth knowledge of statutes, ordinance, and rules of the Court.
Qualifications
DUTIES AND RESPONSIBILITIES
- Prepare folders and citation jackets on new charges.
- Request certified driving records, retrieve criminal records, police reports, accident reports, supplemental reports, digital photo and video files, and evidence, and prepare this documentation for the prosecutor.
- Preparation and distribution of discovery to all involved attorneys in each criminal matter.
- Establish and maintain contact with victims/witnesses on appropriate cases – includes sending questionnaires and information to all parties involved, ensuring they are properly informed of all court proceedings and actions.
- Take citizen complaints and educate the general public on legal process. Handle all walk-in inquiries regarding fines, complaints, and requests for general information.
- Print and assemble trial dockets weekly and prepare all documentation for the prosecutor.
- Timely distribution of court subpoenas, communication with the prosecutor of all inquiries about plea bargains, diversions, and dismissals; cancellation of subpoenas when necessary, prepare diversions and dismissals as necessary.
- Prepare and mail all Notice to Appear letters to defendants who failed to appear in court, who have not paid costs/fines, who are on supervised probation and failed with those requirements.
- Following guidelines set by the prosecutor, post administrative fees, dismissals or court costs on traffic cases, and make determinations regarding eligibility on amendments and diversions. Process diversion agreements and explain to violator prior to signature. Explanation of suspension and driver’s license restriction periods. Monitoring of all cases on diversion.
- Assist the prosecutor on court day with management of defendants, verifying driving records, insurance, vehicle registrations, and post court action in respective court files.
- Preparation of all paperwork relevant to fines paid, failure to appears, probation revocations, and mailing of paperwork as necessary.
- Complete Kansas Adult Disposition Reports (KADRs) on all Class A and B misdemeanors and arrest cases and forward to the Kansas Bureau of Investigation (KBI)
- Cross-train on all aspects related to the duties on the Municipal Court Clerk side (specific duties and responsibilities are listed in the Municipal Court Clerk job description).
- Taking and processing payments through the city’s financial management system.
POSITION COMPETENCIES
- Ability to read and understand basic criminal codes, such as the UPOC (Uniform Public Offense Code) and STO (Standard Traffic Ordinance) books.
- Ability to read, understand, and become familiar with Kansas state statutes.
- Skilled using standard office equipment (e.g., telephone, printer, photocopier, fax machine, calculator), as well as computers and peripheral equipment (e.g., personal computer, computer hardware/software, and scanners).
- Knowledge of the city’s financial and case docket management system for input, look-up, taking payments, printing reports, and other duties.
- Knowledge of the police department’s records management system.
- NCIC training and certification.
- Maintain a professional demeanor during stressful situations. This includes: interacting with the public, co-workers, departmental staff, attorney’s, judges, service providers and others associated with daily court business.
- Customer service skills, the desire to treat all people with respect, the ability to communicate both verbally and in writing.

The ability to make a reasonable decision when necessary in accordance with established city and department policies and procedures.

- Ability to read and interpret documents such as legal documents and manuals. Maintain alphabetical filing systems for current and old files which include 50 year old files.
- Knowledge of applicable City and department policies, procedures, rules, and regulations.
- Knowledge of courtroom procedures, etiquette, protocol and terminology.
- Maintain basic knowledge of the operation of the court clerk for cross-application of assigned work duties.
Requirements
EDUCATION
- Must possess a high school diploma or equivalent.
- Minimum one year of clerical experience, or an equivalent combination of education, training, and experience.
- Education sufficient to meet the essential functions of the position.
- Ability to communicate effectively orally and in writing to meet the essential functions of the position.
PHYSICAL DEMANDS
Must possess mobility to work in an office setting and use standard office equipment, including a computer; safely operate a motor vehicle; vision to read printed materials and a computer screen; hearing and speech to communicate in person, before groups, and over the telephone. This is primarily a sedentary office classification although standing in work areas and walking between work areas may be required. Finger dexterity is needed. May occasionally bend, stoop, kneel, reach push, and pull drawers open and closed to retrieve and file information. Employee must possess the ability to lift, carry, push, and pull materials and objects weighing up to 25 pounds.
WORKING CONDITIONS
Work is performed in an office environment with moderate noise levels, controlled temperature conditions, and no direct exposure to hazardous physical substances.
