What are the responsibilities and job description for the Litigation Associate position at Curran Recruiting?
Our client a full-service default and creditors' rights law firm, is seeking an Associate Litigation Attorney for its North Carolina division. The ideal candidate will be a licensed attorney in good standing in North Carolina and South Carolina. Or be willing to get their South Carolina license as well. Experience in foreclosure law, bankruptcy, litigation, and property law is highly desirable. The successful applicant will have will be responsible for managing a diverse litigation caseload involving various property-related matters.
Responsibilities
- Maintain a thorough understanding of state and federal laws and civil procedures, with particular focus on property law, foreclosure, and bankruptcy.
- Manage a litigation caseload involving probate, title curative actions, wrongful foreclosure, title disputes, eviction matters, tax issues, and more.
- Handle cases from referral through to settlement, verdict, or disposition, including attending court hearings, conducting discovery, and drafting necessary documents.
- Respond to disputes and ensure compliance with investor guidelines, state and federal regulations, and applicable laws.
- Provide legal counsel to clients and conduct research on relevant statutes, case law, and legal precedents.
Qualifications
- Juris Doctor (J.D.) degree from an accredited law school.
- Active membership in good standing with the North Carolina State Bar and any additional state bars where you practice.
- Minimum of 3 years of legal experience, with a focus on real estate, finance, or representing financial institutions in real estate matters. Courtroom experience is preferred.
- Experience in real estate, mortgage, or commercial litigation is strongly preferred.
- Knowledge of relevant federal and state laws such as FDCPA, RESPA, TILA, and other debt collection and real property regulations is a plus.
- Experience in foreclosure, bankruptcy, or evictions is preferred, though candidates willing to learn these areas are encouraged to apply.
