Civil Enforcement Division, Civil Recovery Section
The Oregon Department of Justice is seeking applicants for an attorney position in the Civil Recovery Section of the Civil Enforcement Division. This position may be based in our Portland, Salem or Eugene offices, with opportunities for some remote work. The Civil Recovery Section represents all state agencies, boards, and commissions in bankruptcy cases, receiverships, collections, foreclosures, and a wide variety of civil litigation. This position offers a diverse bankruptcy, creditor’s rights, and collection practice, including:
  • Representation of state agencies in consumer and business bankruptcy cases.
  • Participation in national chapter 11 bankruptcy cases, including mega cases.
  • Adversary proceedings, including nondischargeability actions and preference avoidance.
  • Contested case proceedings, including objections to confirmation, motions to dismiss, claims disallowance, automatic stay litigation, and discharge injunction proceedings.
  • State court receiverships.
  • Judicial and nonjudicial foreclosures.
  • Secured transactions and statutory lien analysis.
  • Advice and litigation in complex creditor-rights matters.
  • Complex civil litigation, including commercial, environmental, breach of contract and wildfire litigation.

Required
  • Active membership in good standing with the Oregon State Bar by the time of appointment.
  • At least five (5) years of experience representing clients in bankruptcy cases and independently managing a bankruptcy caseload.
  • Civil litigation experience.
  • Possess superior analytical, advocacy, research, verbal communication, and writing skills.
  • Strong work ethic.
  • Client counseling skills.
  • Collaborative work history with lawyers and non-lawyers.
  • Demonstrated commitment to diversity, equity, and an inclusive working environment where diverse individual experiences and perspectives are valued and supported.
Desired Experience
  • Candidates with experience working on both consumer and business bankruptcy cases are preferred.
  • First chair trial experience is preferred.
  • Commercial litigation experience.
  • Receivership experience.

This OAJA-represented position will be filled at either the Assistant Attorney General or Senior Assistant Attorney General level, salary range $8,842.00 - $17,168.00 per month, depending primarily on years of legal practice experience and other factors. Employees who are Public Employee Retirement System (PERS) participating members will have their base salary increased by 6.95% and pay a 6% employee contribution to PERS; the salary range noted reflects base salary only.
