Characteristics of the Class : The position allocable to this exempt classification will work with and at the direction and supervision of one or more senior attorneys assisting departments with various municipal law matters including the Brown Act, Public Records Act, public contracting and procurement, real estate, affordable housing development, municipal finance and policy preparation and updates. In addition, the position will provide legal support to the Housing Authority (and its instrumentalities) regarding public housing, Section 8 vouchers, and other subsidized housing programs. This classification differs from the Staff Attorney I (Transactional) in that the duties and responsibilities are more difficult and complex, requiring a higher degree of knowledge, initiative and independent judgement.
Examples of Essential Functions :
- Assists with responding to Public Records Act requests and subpoenas.
- Prepares and / or reviews contracts, memorandums of understanding and other agreements.
- Prepares and / or reviews real estate related agreements including licenses, permits, real estate listing agreements, loan agreements and recordable instruments such as easements, leases, covenants, and other agreements.
- Assists with document preparation / review and negotiations related to affordable housing and tax credit development and redevelopment.
- Conducts legal research and prepared memorandums as requested.
- Assists with the preparation and updating of policies and procedures and review of NOFAs and RFPs and related due diligence.
- Provides legal assistance with procurement activities under state and federal law.
- Provides legal assistance to ensure compliance with state and federal Public Works contracting requirements.
- Assists with review of Board Reports, Resolutions, and compliance with the Brown Act as may be requested from time to time.
- Assists with other legal matters affecting the Housing Authority as directed.
- Performs other related duties as assigned.
Minimum Requirements :
Member in good standing of the California State bar. Three (3) years of experience preferably working in the areas of municipal law, real estate law, public finance and public contracting. Must be licensed to practice law in California. Candidate must possess :
License Required : Must be a member of the California Bar in good standing.
