Incumbent serves as a Deputy Prosecutor for the Prosecutor’s Office, responsible
for representing the State of Indiana in the prosecution of crimes committed as well as establishing, modifying, and enforcing child support obligations in the 12th Judicial Circuit.
DUTIES:
Represents the State of Indiana in the prosecution of criminal law offenders, including investigating, preparing, and presenting cases before the court, as well as enforcement of child support, and criminal prosecution of felony non-support cases, including investigating, preparing, and presenting cases before the court.
Interviews crime victims, witnesses, law-enforcement personnel, and other persons involved in case investigations, determining need for and type of charges to be filed. Interviews custodial parents to obtain information on paternity, employment, financial status, and other child support related matters. Reviews cases with Prosecutor when necessary and files charges as appropriate. Prepares and appears in court for a variety of case-related proceedings, including but not limited to pre-trial conferences, changes of pleas, paternity actions, petitions for support, support modifications, and all other support related hearings.
Drafts charging information, petitions, motions, pleadings, memorandums, and affidavits alleging contempt relating to establishment and enforcement of child support orders. Prepares and files responses to pleadings and motions made by defendants and/or their attorneys and by respondents and/or their attorneys.
Deputy Prosecutor/Child Support
Calculates child support obligations, reviews calculation sheets to determine accuracy in arrears totals, and utilizes administrative sanctions and remedies toward enforcement of child support orders and collection of due and past due child support.
Meets with crime victims and/or custodial parents to review case progress and answer questions concerning case and general court procedures.
Attends staff meetings and meets with judges to review and/or negotiate court matters concerning cases. Responds to inquiries from officers, case workers, witnesses, and other concerned persons as needed.
Prepares assigned cases for trial, including subpoenaing witnesses, conducting depositions, researching and gathering financial information, viewing evidence, determining trial strategy, and preparing victims and/or witnesses for trial, and drafting/preparing legal documents, motions, memoranda, and orders as needed.
Presents and argues assigned cases in court, including questioning witnesses and presenting evidence and arguments.
Researches and maintains knowledge of case law, statutory law, and administrative law relating to issues of child support, paternity, and Indiana Criminal Law.
Maintains accurate records of all developments in assigned cases. Maintains calendar of court appearances.
Maintains continuing legal education requirements and current knowledge of legal decisions, policies, and regulations, including attending professional conferences, training, seminars, and workshops.
Performs any lawful additional duties assigned by the Prosecuting Attorney or their designee.
I. JOB REQUIREMENTS:
Doctor of law degree from an accredited college or university. Certification as a licensed attorney in the State of Indiana and admission to practice before the Indiana Supreme Court. Must be at least 21 years of age.
Ability to meet all department hiring and retention requirements.
Thorough knowledge of and ability to research and apply federal, state, and local laws to various specific situations and circumstances, and to effectively prepare and argue such cases before the court.
Thorough knowledge of the Indiana Child Support Guidelines established by the Indiana Supreme Court and the Cooperative Agreement between the Prosecutor and Child Support Deputy Prosecutor/Child Support Bureau.
Through Knowledge of federal, state, and local laws governing paternity establishment, child support and standard collection and enforcement practices and policies, with ability to assure proper coordination of child support collection/enforcement procedures accordingly.
Practical knowledge of standard procedures and practices of County courts, with ability to effectively prepare and argue cases before the court.
Practical knowledge of child support, temporary assistance for needy families, and other social services, laws, and policies with ability to make practical applications and answer questions. Working knowledge of standard office procedures and computer software programs used by the Prosecutor’s Office, with ability to apply such knowledge to a variety of interrelated processes, tasks, and operations.
Working knowledge of standard English grammar, spelling and punctuation and ability to prepare detailed written reports, maintain complete and accurate case files, and plan and make public speaking presentations.
Knowledge of Indiana Criminal Code, criminal court case law, Indiana administrative rules, and communication skills in dealing with victims, child victims, juries, judges, and defense attorneys. Ability to properly operate standard office equipment, including computers, calculators, copiers, scanners, and other equipment as needed.
Ability to comply with all employer and department policies and work rules, including, but not limited to, attendance, safety, drug-free workplace, and personal conduct.
Ability to provide public access to, or maintain confidentiality of, department information and records according to state requirements.
Ability to effectively communicate orally and in writing with co-workers, other state and County departments, court staff, public defenders, private attorneys, victims, witnesses, law enforcement professionals, and the public, including being sensitive to professional ethics, gender, cultural diversities, and disabilities.

Ability to maintain continuing legal education and training requirements.
Ability to serve on 24-hour call for emergencies and respond swiftly and rationally to emergencies from off-duty status.
Ability to regularly work extended hours, weekends, and evenings, and travel out of town for conferences and meetings, sometimes overnight.
Possession of a valid driver’s license with demonstrated safe driving record.
II. DIFFICULTY OF WORK:
Incumbent applies a broad scope of laws, rules, and regulations and devises effective approaches for the prosecution of offenders within the state. Independent judgment is needed in adapting general guidelines and accepted procedures to meet specific situations and solve complex and unusual circumstances.
III. RESPONSIBILITY:
Incumbent makes a major contribution to the implementation of department policies and legal action. Assignments are guided by broad policies and/or general objectives, with incumbents referring to supervisor when interpretations of department policies are thought necessary. Work is reviewed primarily for attainment of objectives, soundness of judgment, and compliance with legal requirements. Deputy Prosecutors serve as ministers of justice and must comply with the Indiana ethical rules for prosecutors and guidelines developed by the Indiana Prosecuting Attorney’s Council, Standing Committee on Best Practices.
IV. PERSONAL WORK RELATIONSHIPS:
Incumbent maintains frequent contact with co-workers, other state and County departments, court staff, public defenders, private attorneys, victims, witnesses, law enforcement professionals, and the public for the purposes of exchanging information, rendering services, negotiating legal solutions, prosecuting criminal cases, and providing instruction and mentoring.
Incumbent reports directly to Elected Prosecutor.
V. PHYSICAL EFFORT AND WORK ENVIRONMENT:
Incumbent performs a majority of duties in a standard office environment and in a court room, involving sitting/walking at will, sitting for long periods, driving, lifting/carrying objects weighing under 25 pounds, keyboarding, close vision, hearing sounds/communication, and speaking clearly. Incumbent is regularly exposed to disturbing evidence and distraught and/or potentially violent persons. Incumbent regularly works extended hours, weekends, and evenings, and travels out of town and responds to emergencies on a 24-hour basis.
