Summary:
The position has direct responsibility to manage and oversee all departmental disciplinary hearings at the trial level.  The position ensures effective and timely processing of investigations, pre-trial conferences, trials, union appeals and assists with answering grievances.  The position is charged with providing advice to department heads and senior staff to ensure the consistency and standardization of dispute resolution among the various departments at Metro-North Railroad.
Responsibilities:
  • Responsible to manage, supervise and coordinate the day-to-day activities for all departmental trials, including the work of the Manager, Departmental Hearings and Investigations including the oversight of departmental investigations; the writing of accurate and timely disciplinary charges; the conducting of pre-trials and settlement conferences; the holding of timely and thorough trials; and labor-management dispute resolution.
  • Review, investigate, and provide oversight about all disciplinary charges and departmental reports alleging violations that require disciplinary action.  Instruct department managers in the proper procedures to be followed in preparing appropriate documentation and in the utilization of other investigatory techniques.  Determine when trial waivers are appropriate and recommend decisions based upon trial transcripts.
  • Provide direction to departmental managers and senior management within each department concerning issues of a highly visible nature.  Ensure fair resolution to such issues while maintaining and protecting the interests of the agency.
  • Review, conduct, and address all complicated and sensitive investigations, trials and departmental issues of a highly visible nature.  Ensure fair resolution to such issues while maintaining and protecting the interests of the agency. Ensure equitable and consistent treatment across all departments. Ensure all witnesses are prepared and that all relevant documentation and evidence is available and produced at trial/investigation.
  • Coordinate training programs for managers within departments to enable them to interpret union contracts as well as competently handle and investigate grievances, absence control trials, drug and alcohol trials, rules and safety violations, and proper follow-up procedures.
  • Ensure maintenance of the disciplinary database(s) and analyze data. Ensure fair, equitable, and consistent treatment of employees across all departments
  • Other duties as assigned.
 
Required Qualifications:
 
  • Familiarity with legal rules of evidence and how to prepare and introduce evidence into the record at an administrative hearing.
  • Excellent investigatory and interrogation skills.
  • Familiarity with the Railway Labor Act.
  • Knowledge of labor agreements, the appeals process, trial procedures and the arbitration process
  • Familiarity with the basic principles of contract interpretation in a labor-management setting.
  • Excellent interpersonal skills and the ability to mediate and resolve disputes.
  • Ability to work collaboratively in a large organization. Must have ability to build and maintain effective relationships with management and unions.
  • Supervisory experience at the managerial level.
  • Ability to coordinate and manage multiple diverse issues simultaneously.
  • Proficiency in Microsoft office Suite or demonstrated equivalent.
  • Must have effective communication, presentation, critical thinking/problem solving, decision-making, and negotiating skills.
  • Excellent organization skill with an emphasis on detail and meeting deadlines. Demonstrated ability to conduct thorough and factual investigations and present findings in a clear, concise and persuasive format.
  • Excellent analytical and complex problem solving to make quality decisions.
  • Experience in performing economic analysis and/or accounting functions.
  • Demonstrated proficiency in Microsoft Office Suite or comparable applications, i.e., Word, Excel, PowerPoint, and Outlook. 
Required Education and Experience:
  • Bachelor’s degree in labor relations, Human Resources or a related field/ or a Law degree.
  • Minimum of 7 years demonstrated, recent, directly related Labor Relations experience or 3 to 5 years’ of such experience with a Law Degree.
  • Minimum 3 years’ experience handling a large workload including the timely scheduling and resolution of cases.
  • Minimum 2 years’ experience in a supervisory role preferably at the managerial level.
Preferred:
  • Law Degree with experience with trials and/or administrative hearings.
  • Experience in labor-management dispute resolution.

May need to work outside of normal work hours (i.e., evenings and weekends)

Travel may be required to other MTA locations or other external sites.
According to the New York State Public Officers Law & the MTA Code of Ethics, all employees who hold a policymaking position must file an Annual Statement of Financial Disclosure (FDS) with the NYS Commission on Ethics and Lobbying in Government (the “Commission”).
Employees driving company vehicles must complete defensive driver training once every three years for current MNR drivers; or within 180 days of hire or transfer for an employee entering an authorized driving position.
