ESSENTIAL DUTIES & RESPONSIBILITIES
Under the supervision and direction of the Principal – Compliance Manager, the Compliance Analyst will ensure implementation and monitoring of agency-wide compliance programs:
- Assist with the administration of agency-wide compliance policies and MTC’s DBE and SBE programs, procedures and software systems specifically working with internal and external parties to develop goals, monitor utilization, enforcement, and annual / as-needed reporting.
- Work with internal and external stakeholders to ensure proper compliance and reporting in regard to grant requirements.
- Ensure compliance with provisions of applicable state and federal laws, regulations, rules, and guidelines; and perform a variety of professional duties in support of DBE, SBE, Title VI, ADA programs, and prevailing wage requirements, including representing MTC to internal and external stakeholders, public and private organizations, and others in matters pertaining to DBE, SBE, Title VI, ADA, and labor compliance.
- Present information regarding MTC’s DBE and SBE programs at proposer conference meetings for all agency procurements.
- Provide training, technical assistance, and resources to contractors/consultants, agency staff, and others as needed on program requirements and post award contract administration.
- Research, develop, prepare, and present written and oral utilization, demographic, and/or program reports.
- Prepare and submit various agency, federal, state, and local reports and documents related to utilization of subconsultants, compliance activities, DBE, SBE, Title VI and ADA programs.
- Consult with the Office of General Counsel (OGC) and other departments/external parties as necessary in the implementation of compliance programs.
QUALIFICATIONS
KNOWLEDGE, SKILLS, & ABILITIES
The ideal candidate in this position must possess the following knowledge, skills, and abilities:
- Applicable state, federal, and local labor and/or contracting laws, policies, and procedures and the ability to monitor and enforce those requirements in highly variable and diverse procurements (including professional services and construction), work situations and environments.
- State and federal funding programs and procedures.
- Competitive bid practices/procedures and types of competitive solicitations, particularly negotiated procurements; forms of agreements; principles, practices and terminology related to the administration of construction, goods, and professional and technical services contracts.
- Theories, principles, and practices of public sector procurement and contract processes.
- Principles and practices of programs, such as Title VI, DBE, SBE and ADA compliance programs.
- DBE, SBE and ADA administrative principles and methods, including goal setting, program and budget development and implementation.
- Principles of technical analysis, data analysis and report writing.
- Labor compliance related to public works projects including prevailing wage requirements and compliance.
MINIMUM QUALIFICATIONS
An appropriate combination of education and experience that has provided the required knowledge, skills and abilities is qualifying. A typical way of obtaining the required qualifications is:
Education: High School degree or GED, and minimum of 15 units of technical training as a legal assistant or contract administration assistant.
Experience: Two years of experience equivalent to that of an Administrative Assistant III in MTC, or four years of progressively responsible secretarial or office administrative experience, including one year of paralegal or contract assistant experience, preferably in the public sector or law office.
PREFERRED QUALIFICATIONS
Education: Completion of a Bachelor's degree from an accredited college or university required. Degree should be in an appropriate discipline such as public administration, business administration or a related and applicable field. Work experience of a minimum of five (5) years in government procurement, contracting and/or compliance can be substituted for the education requirement. Applicants with a degree issued from an institution outside the United States must have their transcripts evaluated by an academic accrediting service and provide proof of equivalency along with the application.
Experience: Minimum two years of increasingly responsible, relevant, and verifiable professional experience in government agency procurement and monitoring, reporting and enforcing compliance requirements related to federal, state, and local funding sources. Additionally, a minimum of two years increasingly responsible, relevant, and verifiable professional working experience within DBE, SBE and/or ADA Programs, including monitoring and reporting compliance with requirements of said programs. Transportation, transit agency and/or public agency contract management experience is desirable.
License/Certificate: Possession of a valid California Class C driver’s license and a safe driving record, or the ability to provide alternate transportation which is approved by the appointing authority.
