The expected salary ranges for this role on hire are:

Assistant County Attorney I: $77,738 - $104,639

Assistant County Attorney II: $88,406 - $129,827

Assistant County Attorney III: $108,687 - $165,794

Who We Are

The Office of the County Attorney provides legal advice and representation to all County departments, agencies, instrumentalities, boards and commissions, including the County Council, and all their employees. The Office also provides legal defense for cases involving Montgomery County and other governmental entities which participate in the Montgomery County Self-Insurance Program (including the Board of Education for Montgomery County, Montgomery College, and the Housing Opportunities Commission) and all their employees

Who We Are Looking For

The Litigation Division provides the legal defense for Montgomery County, the Board of Education for Montgomery County, Montgomery College and various local government entities. The Litigation Division defends these entities and their named employees who are sued for money damages based on actions or inactions which occurred within the scope of their employment.

The attorney selected for this position will appear regularly before state and federal courts in Maryland for trials and oral arguments and may occasionally appear in the courts in the District of Columbia. The attorney will defend claims alleging negligence, common law torts, police civil rights violations, constitutional torts, employment discrimination, sexual harassment, American with Disabilities Act, Individuals with Disabilities Education Act, Title IX, and other topics.

What You'll Be Doing

  • Review, analyze, and respond to Complaints in Maryland state and federal courts
  • Research relevant legal issues
  • Prepare and argue various types of motions, including dispositive, evidentiary, discovery and motions in line
  • Gather necessary facts from clients and witnesses, retain appropriate expert witnesses, draft, answer, and analyze complex written discovery including electronically stored information
  • Take and defend depositions
  • Prepare for and conduct bench trials and jury trials
  • Participate in mediations
  • Interpret laws, rulings and regulations for local, state or federal government
  • Prepare and present oral arguments
  • Evaluation and settlement of claims

Minimum Qualifications

Education : Graduation from an accredited university school of law.

Experience

  • At the Assistant County Attorney I level, Grade 24: One (1) year of p ost degree experience as a law clerk or in a similar capacity .
  • At the Assistant County Attorney II level, Grade 27: Two (2) years of professional experience as an attorney, including trial experience.
  • At the Assistant County Attorney III level, Grade 32: Thorough (four (4) years) experience as an attorney, including some specialized (one (1) year) experience involving either local government law or civil litigation.

Equivalency: None.

LICENSE:

  • Membership in the Maryland State Bar. Note: There will be no substitutions for this section

Preferred Criteria, Interview Preferences

All Applicants will be reviewed by the Office of Human Resources (OHR) for minimum qualifications. Those applicants who meet minimum qualifications will be rated “Qualified,” placed on the Referred List, and may be considered for an interview. Employees meeting minimum qualifications who are the same grade or higher will be placed on the Referred List as a “Transfer” candidate and may be considered for an interview.

Preference for interviews will be given to applicants with experience in the following:

  • Experience in the areas of law handled by the Division.
  • Trial skills and experience
  • Knowledge of local government law
  • Organization skills
  • Ability to cope with exposure to difficult subject matters
  • Ability to deal with people effectively in difficult high stress circumstances
  • Ability to work collaboratively and on a team

Montgomery County Ethics Law : Except as provided by law or regulation, the County's "Public Employees" (which does not include employees of the Sheriff's office) are subject to the County's ethics law including the requirements to obtain advanced approval of any outside employment and the prohibitions on certain outside employment.
