    The Mission of the Department of Public Instruction :

    The North Carolina Department of Public Instruction (NCDPI) is charged with implementing the state's public school laws for pre-kindergarten through 12th grade public schools at the direction of the State Superintendent of Public Instruction and State Board of Education.

    The North Carolina Department of Public Instruction is seeking applicants for an Education Program Director I (Working Title : Section Chief- IDEA Dispute Resolution) for our Office of Exceptional Children / IDEA Dispute Resolution / Educator and Student Advancement.

    The Office of Exceptional Children / IDEA Dispute Resolution / Educator and Student Advancement is responsible for providing a continuum of dispute resolution options and practices, including early informal assistance and alternatives to due process and formal special education state complaints. This section provides technical assistance and professional learning to stakeholders regarding the implementation of federal regulations, state statutes, and state board policies.

    This position, Section Chief – IDEA Dispute Resolution, is responsible for :

    • Supervising the coordination of all dispute resolution processes (Facilitated IEP Team Meetings, Mediation, Due Process, and Special Education State Complaints)
    • Developing and tracking budget expenditures for the provision of dispute resolution services and services provided by the consultants and parent liaison assigned to this section
    • Assisting in the review, revision, and / or implementation of federal regulations, state statute, and state board rules and policies
    • Serving as liaison to the Office of Administrative Hearings
    • Contributing to the leadership of the Office of Exceptional Children (OEC) as a member of its Leadership Team
    • Serving as designee for the Senior Director or Assistant Directors as appropriate in matters regarding rulemaking, the development of policies, practices, and procedures specific to the implementation of the Individuals with Disabilities Education Act (IDEA)
    • Reviewing technical assistance and professional learning materials to ensure best practices established by the OEC are consistent with state and federal requirements
    • Collaborating with stakeholder groups to continuously improve dispute resolution activities (i.e., Duke Law Clinic, Disability Rights North Carolina, etc.)
    • Ensuring the accuracy of written correspondence / materials / reports specific to the analyses of federal regulations, state statute and state board policies for formal special education state complaints, parent rights, child find materials, and any other formal publications from the OEC
    • Responding, in collaboration with the OEC Senior Director and Assistant Directors, to legislative inquiries, other staff members in the Department of Public Instruction, the Attorney General’s office, and other agencies in state government (i.e., NC Department of Health and Human Services, NC Division of Juvenile Justice, etc.)
    • Documenting procedures for North Carolina’s dispute resolution system
    • Coaching and evaluating five dispute resolution consultants and one parent liaison
    • This position is based in Raleigh and requires 10-20% statewide travel for technical assistance and professional learning activities.

      Minimum Requirements :

    • Demonstrated experience implementing federal regulations and / or public school law specific to educational services for children with disabilities.
    • Demonstrated experience providing professional learning to stakeholders regarding the implementation of the Individuals with Disabilities Education Act (IDEA).
    • Demonstrated experience supervising and / or coaching staff providing services or supports to exceptional children in public schools.
    • Management Preferences :

    • Experience in technical writing and / or educational research specific to students with disabilities.
    • Experience participating in facilitated IEP team meetings, mediation, due process, and / or special education state complaint investigations.
    • Master's degree in education or in the special education field to which assigned from an appropriately accredited institution, and four years progressively responsible experience in public education, or a Doctoral degree in education or in the special education field to which assigned from an appropriately accredited institution, and two years of progressively responsible experience in public education; or an equivalent combination of education and experience.
