\n- Legislative & Regulatory Compliance
- Proactively monitor, track, and analyze state and federal legislative and regulatory developments impacting New Western’s operations.
- Interpret complex regulatory language and assess business implications.
- Identify upcoming legal risks and prepare the business to stay ahead of state-specific compliance requirements, particularly in real estate and financial services.
- Utilize legal research tools and legislative tracking systems (e.g., Stateside) to stay current on compliance obligations.
- Lead the company’s TCPA compliance efforts, including processes related to call/text permissions and opt-out protocols.
- Policy Development & Compliance Monitoring
- Develop and implement internal compliance policies and procedures in response to new or evolving regulatory requirements.
- Integrate legislative and regulatory requirements into operational workflows, contracts, and disclosures.
- Ensure consistent application and enforcement of compliance protocols across departments and teams.
- Support the business in developing mechanisms to monitor and audit internal adherence to relevant laws and regulations.
- Legal Advisory & Risk Mitigation
- Serve as a business-facing legal partner, offering practical and balanced guidance on regulatory obligations.
- Analyze legal gray areas and assess risk levels in partnership with leadership.
- Translate legal concepts into actionable business strategies without taking overly conservative stances that hinder growth.
- Collaborate with Legal and Compliance teams on multifaceted legal issues, balancing compliance with operational efficiency.
- Data Privacy & Security
- Advise on evolving state and federal data privacy regulations and their operational impact.
- Draft and maintain legally compliant website and app privacy policies, disclosures, and terms of use.
- Work cross-functionally to implement processes that safeguard Non-Public Personal Information (NPI) and support best practices in data handling and retention.
- Lobbying & Industry Engagement
- Assist with New Western’s growing lobbying initiatives, including collaboration with internal stakeholders, trade associations, and political action committees.
- Track and report on lobbying activity, emerging policy trends, and key stakeholder conversations.
- Represent the company in industry working groups and compliance forums, bringing back insights that inform strategy and advocacy efforts.
- In-house counsel or major law firm background preferred
- JD from an accredited law school (required)
- Licensed to practice law (Texas preferred, but any U.S. state accepted)
- 5 years of experience as a practicing attorney, with at least 3 years in: Regulatory tracking, compliance, or audit in a highly regulated industry (real estate, telecom, oil & gas, healthcare, etc.) Advising clients on state/federal legal obligations
- Comfortable working with ambiguity, gray-area regulations, and business risk assessments
- Ability to present to senior leadership and cross-functional teams
- Demonstrated strong communication skills, both written and verbal
