In-House Counsel (Litigation, Collections, and Creditors’ Rights Bankruptcy Litigation)

Position Overview:
PowellPath Group is seeking a full-time In-House Counsel to join our legal team immediately, with a primary focus on creditors’ rights, collections, and high-level bankruptcy litigation. In this role, you will represent multiple privately held companies and their officers in matters involving the collection of debts, enforcement of judgments, and strategic courtroom advocacy. We are looking for an attorney with a proven track record in creditor-related bankruptcy proceedings, substantial courtroom experience, and a comprehensive understanding of Georgia bankruptcy law and landlord-tenant regulations.
Key Responsibilities:
- Creditors’ Bankruptcy Representation: Manage Chapter 7 and Chapter 11 cases from the creditor’s perspective, including filing proofs of claim, objecting to plans/discharges, and navigating complex legal strategies to maximize recoveries.
- Collections & Judgment Enforcement: Oversee and execute the entire collections process, from demand letters to post-judgment enforcement, ensuring aggressive pursuit of outstanding debts while adhering to all legal and ethical standards.
- Litigation & Trial Work: Develop and implement litigation strategies, conduct formal court appearances, and try cases to resolution—focusing on outcomes that protect and advance our companies’ financial interests.
- Case Management: Assume responsibility for an established caseload, driving each matter through to completion and coordinating effectively with outside counsel when necessary.
- Negotiations & Settlements: Negotiate with opposing counsel on behalf of our corporate entities, striking a balance between proactive settlements and decisive trial advocacy.
- Regulatory Compliance & Advisory: Provide counsel on Georgia bankruptcy laws, landlord-tenant issues, and any additional relevant regulations to mitigate legal risks across our diverse corporate portfolio.
Qualifications:
- Licensed to Practice in Georgia (Additional bar admissions are beneficial but not required)
- Substantial Experience in Bankruptcy Law (Creditors’ perspective, including Chapter 7 and Chapter 11)
- Proven Litigation Record (Court appearances, trial work, and dispute resolution)
- Strong Negotiation Skills (But comfortable taking cases to trial when necessary)
- Immediate Availability (Urgent matters require prompt onboarding and engagement)
