What you will be doing :
Provide day-to-day employment law advice and legal support regarding internal investigations and document outcomes in a privileged and confidential manner.
Draft severance agreements, termination documents, performance improvement plans, and other communications and policies in a legally compliant manner.
Draft and revise employment handbooks, policies, and procedures to ensure clients comply with federal and state laws and regulations.
Represent clients in nationwide employment litigation defense, from single-plaintiff cases to large class or collective actions.
Handle nationwide coverage for regulatory complaints from federal, state, and local enforcement agencies related to employment issues.
Conduct audits for wage and hour compliance to ensure proper classification of employees under relevant laws and defend against DOL and state agency investigations.
Review affirmative action compliance, ensuring affirmative action plans meet O.F.C.C.P. requirements and addressing all 'money-issues' (e.g., hiring, firing, transfers, promotions, demotions, and pay equity).
Draft, review, and revise executive-level offer letters and employment agreements.
Draft and enforce arbitration agreements, non-compete agreements, and client non-solicitation provisions.
Analyze for discriminatory treatment or impact in employment practices, including pay disparities.
Provide training in all aspects of employment law, from wage and hour compliance to F.M.L.A., to prevent workplace harassment or misconduct.
Conduct due diligence for potential mergers and acquisitions to identify legal exposure and risks pre-closing.
Conduct WARN Act research, drafting, and advice regarding compliance with federal and state notice requirements for layoffs or furloughs.
Perform a secure, technical Form I-9 audit to ensure compliance and proper onboarding of employees according to federal and state laws.
Experience you will need :
We are looking for Depart of labor investigations, implement litigation experience and not looking for an attorney with expertise focused on ERISA (Employee Retirement Income Security Act), which governs employee benefit plans like retirement and health insurance.
JD Degree from an ABA-approved law school.
Top half of law school class, participation in law review, and / or moot court preferred.
Employment law experience is preferred, but not required; insurance coverage experience is helpful.
Licensure in multiple states and federal court admissions is beneficial.
Familiarity with Microsoft Office products.
Comfortable in a paperless environment.
Ability to manage and prioritize a large caseload.
Strong analytical skills to develop strategies for case management.
Independent and highly motivated.
Excellent research, writing, and communication skills.
