SUMMARY
The General Counsel and Corporate Compliance Officer provides legal advice to Red Rock BHS on a variety of legal issues and manages the Agency’s compliance program. The General Counsel / CCO will ensure that the Agency operates within the law at all times and will serve as an effective guardian of the Agency and the executive team. The General Counsel / CCO oversees the Legal / Compliance Department and the Quality Assurance Program. The General Counsel assists the CEO with high-level, complex projects and may represent the CEO in the community as assigned.
ESSENTIAL FUNCTIONS AND RESPONSIBILITIES
- Oversee the Legal / Compliance Department which includes compliance, medical records, quality assurance, clinical technical support, and the access center programs
- Advise executive and senior management on various matters such as employee relations, healthcare law, legal rights, and new and existing laws
- Draft and review contracts, leases, employment agreements, memorandums of understanding, business associate agreements, and other legal documents
- Maintain and oversee the compliance department to ensure compliance with laws, ethical standards, and Red Rock’s policies and procedures
- Research, analyze, and interpret laws
- Keep current on new rules and guidance from accrediting and funding agencies
- Oversee Quality Assurance Program and QAP Coordinators
- Develop and implement quality assurance program including chart audits, assessment of quality of clinician chart, and gathering data to improve outcomes
- Ensure clinical compliance with certifying, accrediting, and funding bodies
- Assist in drafting corporate plans
- Participate in fundraising and development projects
- Help draft and ensure compliance for forms used in the electronic health record
- Monitor Fraud and Abuse hotline and reports
- Conduct internal investigations related to fraud and abuse
- Compile reports for management team and board
- Ensure compliance with federal, state, and local laws
- Monitor legal risks by examining current and proposed legislation and regulations
- Exceptional customer service
- Assist in reviewing program plans, orientation guides, and other documents for compliance
- Maintain updates on insurance contracts, as needed
- Manage litigation and investigations by administrative or third party agencies
- Communicate with third parties seeking information
- Draft internal memos to update staff on important legal issues
- Communicate with agencies, local law enforcement, and the legal community on thresholds required to disclose personal health information, staff testimonies, and other information related to client privacy
- Oversee privacy program related to personal health information and clients’ privacy rights
- Conduct trainings on privacy, common legal issues, and laws related to mental health and substance use disorders
- Remain available to directors and staff to answer questions and address legal issues that arise
- Retain, update, and renew corporate documents
- Ensure internal policies and procedures are up to date and consistent with current practices
- Review and respond to subpoenas, court orders, and warrants to determine if they sufficiently meet legal requirements
- Prepare staff to testify in legal proceedings
- Track legislation and direct implementation as needed following passage of applicable laws
- Serve as Board Secretary for subsidiaries, Red Rock Military Services and Red Rock Cares Foundation
- Serves as a gatekeeper to the CEO as assigned
- Performs other duties as assigned
