Job Description for a PIP Paralegal in Insurance Defense
This role involves supporting attorneys in managing disputes between medical providers, other insurance carriers, and an auto insurance company (the client) regarding PIP benefits. The paralegal will assist in arbitration and litigation processes to defend the insurer’s position.
Responsibilities
• Case Analysis: Review and analyze claims from medical providers or other insurance carriers for PIP benefits. This includes evaluating medical necessity, policy coverage, and compliance with New Jersey PIP statutes.
• Document Preparation: Draft pleadings, responses to discovery, motions, arbitration submissions, and other legal documents specific to PIP disputes.
• Record Review: Obtain and review medical records, bills, Explanation of Benefits (EOBs), pre-certification requests, and appeals to assess the validity of claims.
• Legal Research: Conduct research on New Jersey PIP laws and regulations (e.g., NJSA 39:6A) and apply findings to support defense strategies.
• Client Communication: Maintain regular communication with the auto insurance company to provide updates on case progress and gather necessary information.
• Fraud Investigation Support: Assist in identifying potential fraud (e.g., staged accidents or inflated medical billing) and collaborate with special investigation units (SIUs) when necessary.
• Arbitration Preparation: Prepare for arbitration hearings by organizing evidence, drafting summaries of key issues, and coordinating with witnesses or experts.
• Administrative Tasks: Manage case files, track deadlines, schedule depositions or hearings, and ensure compliance with procedural requirements.
Skills and Qualifications
• Strong understanding of New Jersey’s no-fault auto insurance laws and PIP regulations.
• Familiarity with medical terminology and billing practices.
• Excellent organizational skills with the ability to manage a high-volume caseload.
• Proficiency in legal software (e.g., case management systems) and e-filing systems used in New Jersey courts.
• Ability to work collaboratively with attorneys while independently handling assigned tasks.
Education and Experience
• Paralegal certification or degree in legal studies is required.
• At least 2–3 years of experience in insurance defense or PIP litigation is preferred.
