Description Of Job
The Colorado Division of Insurance (DOI) regulates the insurance industry in Colorado. DOI helps consumers by answering their questions, investigating their complaints, and helping them to understand their insurance. The division regulates and monitors insurance companies in Colorado, as well as insurance agents, ensuring all are following the law.
This work unit exists to ensure that all regulated entities operating in the Colorado insurance market are in compliance with all state insurance laws. The work unit regulates the activities of the insurance industry by ensuring that companies’ activities comply with statutory and regulatory mandates; by ensuring that insurers and producers abstain from deceptive or misleading practices; and by providing reliable market conduct and market analysis information to other sections of the Insurance Division (“Division”), consumers, legislators, regulators and the insurance industry. The work unit analyzes the insurance market and assesses how it is functioning. It identifies and analyzes complex legal and regulatory issues, analyzes and applies insurance laws, and develops strategies for addressing each regulatory issue that is identified. The work unit performs market conduct actions and market conduct examinations to address instances of non-compliance, and shares information and coordinates regulatory actions with other state regulators and the National Association of Insurance Commissioners (“NAIC”) as necessary.

This position is responsible for performing all aspects of the market conduct examination process. The position serves as the Examiner in Charge, and main point of contact, for all activities related to the market conduct examination functions performed by the Insurance Division. The position is responsible for the oversight, timely completion of, and tracking of all of the Insurance Division’s market conduct examinations. This position develops and implements policies and procedures related to the market conduct examination process. The position also maintains an in-depth understanding of Colorado insurance law, the NAIC’s Market Regulation Handbook, and current issues in all applicable insurance areas related to market conduct.

The position serves as the Examiner in Charge, and main point of contact, for all activities related to the market conduct examination functions performed by the Insurance Division. The position is responsible for the oversight, timely completion of, and tracking of all of the Insurance Division’s market conduct examinations. This position develops and implements policies and procedures related to the market conduct examination process. The position also maintains an in-depth understanding of Colorado insurance law, the NAIC’s Market Regulation Handbook, and current issues in all applicable insurance areas related to market conduct.
Duties Include, But Are Not Limited To
- Create and maintain a list of regulated entities in need of a Market Conduct Examination (MCE) including documentation of the trigger, information on market share and compliance concerns and in coordination with the Lead Market Analyst, Director, and internal stakeholders;
- Initiate the MCE process including issuing statutorily required notices and all MCE-related activities pursuant to statutory timeframes;
- Publish requests for bids from external examination companies (examiners), review proposals objectively, award contracts and effectuate the contract pursuant to the Division’s procurement process;
- Document the Market Actions Tracking System (“MATS”), a National Association of Insurance Commissioners online examination tracking system used by all states; the Division’s internal database, SIRCON, with all activities related to the MCE with sufficient narrative to understand the MCE activities;
- Monitor examiners’ work product to ensure MCE is proceeding correctly based on internal procedures, statutory requirements, and the NAIC’s Market Regulation Handbook;
- Ensure examiners provide detailed monthly reporting including any obstacles or other concerns regarding the MCE process including any budgetary concerns;
- Ensure the examiners submit monthly invoices, the regulated entity pays the invoices timely, and the MCE budget remains sufficient;
- Schedule and attend regular meetings with the examiners and the regulated entity under examination to discuss the status of the examination and ensure the MCE is proceeding effectively and efficiently by identifying and resolving obstacles. Escalate any concerns appropriately;
- Conduct ongoing oversight of the MCE and maintain a full understanding of all compliance concerns as they are identified by the examiners and the regulated entity’s position regarding the alleged violation(s);
- Assess and track civil penalties on the regulated entity for failing to respond to or late responses to examiner’s requests, if/when necessary, and ensure regulated entity complies with required payments;
- Appropriately engage the Market Regulation Director, Division’s Subject Matter Expert (SME), and/or Attorney General (AG) to discuss and evaluate alleged violations when needed;
- In coordination with examiners, ensure draft report of findings is completed timely;
- Conduct initial drafting of reports to ensure findings are valid, supported and well documented;
- Identify and develop mandatory corrective action plans;
- Coordinate meetings with examiners and regulated entities to discuss issues as they may appear on the report. Maintain and document regulated entity’s position on the issues and determine what issues will remain and what issues will be removed, if applicable;
- Ensure final draft is reviewed by appropriate Division leadership before sending to the company for review and discussion;
- Determine and recommend monetary penalties to be included in the final report and Final Agency Order (FAO);
- Ensure final report and FAO is reviewed by appropriate Division leadership before submitting to the Commissioner for approval.;
- Conduct market analysis and undertake other non-examination continuum actions;
- Maintain active involvement in appropriate NAIC meetings.

- Eight (8) years of professional*experience in either one (1) of the following two (2) areas:
- Working in an insurance regulatory environment performing field market conduct examinations and audits, analyzing the practices of insurance entities to determine regulatory compliance, and performing analysis of the insurance market; OR
- Working in the insurance industry performing corporate compliance functions to ensure company operations meet internal policies and rules, as well as regulatory requirements. This experience includes evaluating, auditing, correcting, and monitoring activities within an organization related to rating, claims handling, underwriting, marketing and/or policy services to ensure regulatory compliance, and experience working directly with insurance regulators to facilitate market conduct examinations.
- Associate’s Degree and Experience: Graduation from an accredited college or university with an associate’s degree in accounting, business administration, economics, public health, healthcare administration, finance, public administration, statistics, or in a closely related field; AND
- Six (6) years of professional* experience in either one (1) of the following two (2) areas:
- Working in an insurance regulatory environment performing field market conduct examinations and audits, analyzing the practices of insurance entities to determine regulatory compliance, and performing analysis of the insurance market; OR
- Working in the insurance industry performing corporate compliance functions to ensure company operations meet internal policies and rules, as well as regulatory requirements. This experience includes evaluating, auditing, correcting, and monitoring activities within an organization related to rating, claims handling, underwriting, marketing and/or policy services to ensure regulatory compliance, and experience working directly with insurance regulators to facilitate market conduct examinations.
- Bachelor’s Degree and Experience: Graduation from an accredited college or university with a bachelor’s degree in accounting, business administration, economics, public health, healthcare administration, finance, public administration, statistics, or in a closely related field; AND
- Four (4) years of professional* experience in either one (1) of the following two (2) areas:
- Working in an insurance regulatory environment performing field market conduct examinations and audits, analyzing the practices of insurance entities to determine regulatory compliance, and performing analysis of the insurance market; OR
- Working in the insurance industry performing corporate compliance functions to ensure company operations meet internal policies and rules, as well as regulatory requirements. Substitutions
- Partial credit toward the degree requirement will be given for completed college/university coursework that did not result in a degree.A master's or doctorate degree from an accredited college or university in a field of study related to the work assignment will substitute for the bachelor's degree requirement.
- Certification, registration, or licensure related to the work assigned will count for one (1) year of the requirement.
