The Office of General Counsel (OGC) serves as in-house counsel for the NMDOT. With its general counsel appointed by the Governor, the rest of the staff are classified state employees. In all, OGC is an office that currently consists of 12 attorney positions, 5 paralegal and legal assistant positions, and a business support manager. Legal practice areas include administrative/operations support, employment and labor, contracts and procurement, torts, right-of-way/eminent domain, and construction and finance. The OGC is comprised of three practice groups: (1) Operations and Finance, (2) Right-of-Way, and (3) Administration, Contracts and Employment.
Why does the job exist?
The Office of General Counsel (OGC) serves as in-house counsel for the NMDOT. Deputy General counsel (Attorney Supervisor) represents the Department in several of the following practice areas: administrative law; construction law and other real property matters. In addition. the lawyer will devote a substantial portion of time directly supervising work of other Office General Council attorneys, and paralegals. This position will also advise senior management on the most complex and difficult legal and management issues involving agency programs. budgets, and legislation, and may participate on management teams to meet the agency's mission.
How does it get done?
The Attorney Supervisor allocates a substantial portion of time assigning and directly supervising work of at least two (2) full time equivalent employees and serves as both advocate and advisor to the NMDOT.
As advocate, the Attorney Supervisor speaks for the client and presents supportive evidence in court
or before other legal tribunals. As adviser, the Lawyer Supervisor counsels the client on specific
legal rights and obligations.
As a supervisor for attorneys and legal staff, the Attorney Supervisor must assign staffing resources,
define relevant objectives, scope, and policies, and coordinate operations and functions to meet
the goals and objectives of the client agency.
The Attorney Supervisor uses legal precedents and other resources to support opinions and legal
arguments, including electronic databases, public documents and secondary source materials.
The Attorney Supervisor also ensures assigned staff develops experience and competency with these legal tools.
In addition, the Attorney Supervisor acts upon leave requests, conducts annual performance evaluations and recommends disciplinary actions, interviewing and recommending selection of applicants, and conducting training of personnel. Acts as lead counsel for a variety of civil litigation, appellate cases and other legal proceedings, draws up legal documents and manages or advises clients on legal matters and transactions. Procures and oversees outside counsel legal services as required. May specialize in a single area or may practice broadly in many areas of law. Public works highway construction, procurement law and litigation.

Minimum Qualification
Juris Doctorate degree from an accredited school of law and five (5) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Must possess and maintain a valid Driver's License. Must possess and maintain a current Defensive Driving Course certificate from the State of New Mexico or must pass and receive a Defensive Driving Course certificate as a condition of continued employment.

Work is performed in an office setting with exposure to Visual/Video Display Terminal (VDT) and extensive personal computer and phone usage.
