Employment Practices Claims Examiner

USLI
Brook, IL Full Time
POSTED ON 2/15/2025
AVAILABLE BEFORE 4/15/2025

About the Role
We are seeking a dynamic and innovative Claims Examiner to join our team. The ideal candidate is an analytical and creative problem-solver who can quickly identify key issues related to coverage, liability, and damage evaluation. Our examiners are assertive decision-makers with a passion for negotiation and conflict management, thriving on the unique challenges that each claim presents. Collaboration with underwriting, compliance, and actuarial teams is integral to maintaining our products’ health and ensuring fair outcomes.

Essential Functions:

  • Coverage Verification: Review the first notice of loss and policy information to confirm coverage. Prepare initial coverage position letters, including disclaimers and reservations of rights.
  • Claim Investigation: Once coverage is confirmed, conduct a thorough investigation to assess liability and damages. Apply relevant statutory and case law to determine exposure, identify joint tortfeasors, and ensure equitable responsibility.
  • Reserve Management: Establish and adjust reserves as the claim develops, ensuring they accurately reflect ultimate exposure based on liability and damage evaluations.
  • File Management & Negotiation: Maintain proactive file management using an effective diary. Negotiate directly with claimants or their attorneys, oversee defense counsel to ensure effective litigation management, and review/approve settlement agreements. Document all claim activities in substantive file notes.
  • Reporting: Prepare clear, comprehensive reports, including reserve authority requests, reinsurance reports, serious loss reports, and coverage position letters, and share updates with underwriting and other departments.

Other Duties and Responsibilities:

  • Customer Service: Provide prompt responses (within the same day) to phone calls and emails from both internal and external stakeholders, in line with established claim service promises.
  • Special Projects & Continuous Learning: Participate in special projects as needed. Enroll in continuing education to maintain state licenses and support professional and personal development per the annual Individual Development Plan.
  • Travel: Occasional travel for mediations, court hearings, or other claim-related meetings.

Specific Skills:

  • Strong understanding of legal concepts, litigation processes, and agency filings
  • Excellent oral and written communication skills
  • Insightful analytical and effective negotiation skills
  • Superior organizational and time management abilities
  • Technical knowledge of insurance coverage, employment law, and claim evaluation

Minimum Job Requirements:

  • Associate Claims Examiner: 2 years of relevant experience in handling liability matters (e.g., examiner, adjuster, paralegal, attorney, or related roles)
  • Claims Examiner: 7 years of relevant experience
  • Experience with employment practices, D&O, and/or E&O claims; multi-jurisdictional knowledge; advanced degrees and/or a JD are a plus
