What are the responsibilities and job description for the Attorney position at WV Department of Health?
Under the direct supervision of the General Counsel, this role provides legal services to the West Virginia Bureau for Medical Services (BMS) and WV CHIP.
Responsibilities include:
- Drafting and updating contracts and agreements.
- Maintaining expertise in all federal Medicaid statutes, regulations, and guidance.
- Conducting legal research and providing advice to BMS leadership and staff as needed.
- Engaging in written and telephonic correspondence with the Centers for Medicare and Medicaid Services (CMS), BMS’s federal partner.
- Interpreting federal and state statutes, regulations, court cases, and other legal guidance.
- Assisting leadership in developing and drafting the annual legislative agenda, as well as communicating with legislative staff in support of that agenda.
This position will also provide legal support across various areas, including:
- Drafting and filing State Plan Amendments (SPA) for the WV Medicaid Plan.
- Responding to Freedom of Information Act (FOIA) requests.
- Assisting with litigation involving BMS.
- Addressing provider-related Medicaid issues.
- Reviewing and advising on policy manual provisions.
- Reviewing and approving procurement documents.
- Conducting Medicaid document desk reviews (DDRs).
- Working on Medicaid waiver-related documents.
Additional duties may be assigned as needed to support BMS and CHIP operations.
Minimum Qualifications
Training: Graduation from a regionally accredited or American Bar Association accredited law school.

Pay: $50,242.00 - $88,526.00 per year
