Ada County ProsecutorThe Deputy Prosecuting Attorney assigned to Problem-Solving Courts will manage felony cases assigned to the Problem-Solving Courts of the 4th Judicial District in Ada County. The Problem-Solving Court Deputy Prosecutor facilitates cases through the court system to ensure participant is compliant with court rules and requirements, is otherwise compliant with the law, and recommends discharge when the participant is falling below standards. The Deputy Prosecutor assigned to the Problem-Solving Courts and Mental Health Hearings also attends and conducts mental health hearings for those suffering from acute mental health crises to ensure the individual gets the proper community treatment to mitigate their symptoms and keep them and the community safe. The Deputy Prosecutor assigned to Mental Health Hearings will coordinate with relevant experts and facilitate expert testimony to the Court. Mental Health Hearings are handled by a Magistrate judge. This position will learn to work independently and make critical decisions affecting safety of those in acute mental health crisis through case strategy, negotiation, and advocacy.
 
The Problem-Solving and Mental Health Hearing Prosecutor assigned to the Problem-Solving Courts manages felony cases that have been assigned or diverted to one of three Problem-Solving Court programs. Ada County operates three types of problem-solving courts including three separate calendars of Drug Court, Mental Health Court, and Veteran’s Court. Problem-Solving Court is a voluntary diversion program designed to emphasize treatment instead of incarceration. The program provides an opportunity for certain felony offenders to choose closely court monitored rehabilitation instead of penal disposition of their case. DISTINGUISHING FEATURES OF THE CLASS:
The incumbent works independently with management oversight of program related decisions. This position monitors the removal of the participants and the resulting Felony sentencing before the District Court. This position will learn to work independently and make critical decisions affecting case strategy, negotiation, and trial advocacy to ensure the success of the various Problem-Solving Court programs and foremost, community safety.

• Appears in Problem-Solving Courts and documents cases during court proceedings;
• Drafts legal documents such as motions, orders, and memoranda;
• Participates in case negotiations with defense attorneys, which involves analyzing the case to determine whether participation in Problem-Solving Courts is appropriate, its overall strength, evaluating the number and kinds of witnesses available and determining what resolution is appropriate up to and including discharge for current non-compliant participants;
• Prepares for hearings in the District Court by reviewing reports, legal issues, and physical evidence surrounding the case, identifying and interviewing witnesses, consulting with victims, and conferring with police officers;
• Appears in court to represent the State by presenting evidence and argument at arraignments, hearings, pretrial conferences, hearings on motions, evidentiary hearings, sentencings, and Specialty Courts related matters;
• Conducts legal research necessary for case preparation and keeps abreast of Court decisions and legislation affecting the Idaho Criminal Code;
• Attends continuing training related to best practices of the Problem-Solving court model and is responsible for making recommendations related to implementation;
• Demonstrates the conduct and behavior of a team player by helping create a professional and rewarding work environment for all Prosecuting Attorney employees;
• Manages a heavy caseload effectively and in a timely manner;
• Manages and prepares cases, meets discovery deadlines and meets other critical deadlines;
• Supports and interacts with other team members to ensure effective caseload management;
• Communicates effectively and maintains high credibility with the judiciary, law enforcement agencies, victims, witnesses, and co-workers;
• Utilizes the services of the Victim-Witness Unit when appropriate to ease trauma to victims and/or witnesses exposed to the criminal justice system;
• Treats pro se litigants, victims, law enforcement officers, witnesses, members of the public, support staff, colleagues and victim-witness staff with dignity and respect;
• Maintains collegial relationship with defense counsel and treats all counsel fairly.

 
ADDITIONAL FUNCTIONS 

• The Deputy Prosecuting Attorney I assigned to the Problem-Solving Courts shall serve at the direction and discretion of the Prosecuting Attorney and shall perform any and all job functions assigned by the Prosecuting Attorney;
• Attends CLE courses to develop legal advocacy and maintains bar membership and good standing with the Idaho State Bar.

• Graduate of an accredited law school and member of the Idaho State Bar;
• Knowledge of Idaho Statutes, case law, rules of evidence, criminal procedure, and criminal jury instructions;
• Knowledge of online legal research tools such as Westlaw and LexisNexis;
• Knowledge and ability to maintain up to date on the evolving nature of the treatment court model;
• Ability to establish and maintain effective working relationships with victims, witnesses, members of other agencies, and co-workers;
• Ability to maintain confidentiality;
• Ability to communicate effectively and persuasively;
• Ability to be a team player;
• Ability to exercise good judgment;
• Ability to conduct self in a professional manner both inside and outside the courtroom;
• Ability to manage a high-volume case load.

• This position has been designated safety sensitive and therefore the incumbent is subject to random drug testing.
