Associate General Counsel, Product and Regulatory *This position can be located remotely for the right candidate. The Associate General Counsel, Product and Regulatory will report to the Chief Compliance Officer and oversee a wide range of legal considerations surrounding the Company’s healthcare technology product offerings. Specialized areas of focus will include interoperability, data access, information blocking, and value-based care programming. The Associate General Counsel will oversee a team that counsels the development, implementation, and management of regulatory compliance programming across Athena’s existing product lines and strategic initiatives. This role will work mainly with our product, corporate development, and security teams as well as collaborate with almost every function of the Company as a key advisor to the business and leadership. Job Responsibilities Advise on new and existing regulations pertaining to healthcare technology including Office of the National Coordinator for Health Information (“ONC”) Rules on Certified EHR Technology (“CEHRT”), interoperability and information blocking, data access and segmentation, patient privacy, HIPAA, and other state and federal laws and regulations that impact product development. Oversee strategic product initiatives related to value-based care program management, ensuring that service offerings comply with Centers for Medicare and Medicaid Services (“CMS”) rulemaking and other applicable guidelines. Examples of current programming includes the Merit-based Incentive Payments System (“MIPS”) and Medicare Shared Savings Programming. Follow developments in healthcare laws and regulations to develop both new legislative and rule-making activities that could materially impact Athena’s business objectives and/or require updates to internal policies, standards, or procedures to remain compliant with law. Lead efforts to further build product counsel function associated with telehealth/virtual care, Chronic Care Management, corporate practice of medicine and other strategic objectives pertaining to digital health. Provide strategic advice on healthcare regulatory matters affecting the Company’s provision of products and services that considers business objectives, best practices, and existing processes. Become a thought partner to our product teams as they develop new products and features and propose creative solutions to mitigate risk and achieve business objectives. Work with attorneys and other compliance professionals to conduct regulatory risk assessments, develop compliance trainings, playbooks, and FAQ documents designed to successfully educate Athena’s employee base. Typical Qualifications JD from an accredited law school Admitted to a U.S. state bar in good standing. 7 years legal experience ideally at a healthcare or health technology company, a mid to large-sized law firm and/or in government. Superior verbal and written communication skills Strong organizational and time management skills, with experience in people management. Proven ability to advise on regulatory matters in a manner that gains support from business stakeholders and leadership. Demonstrated ability to learn and establish compliance programming in new or emerging areas of legal practice. Adept at operating in a fast-paced work environment.
