Engineering a world of possibilities The Office of Procurement and Contracting provides critical support to the mission by providing comprehensive support for University purchasing. Procurement and Contracting facilitates competitive solicitations, contracting, purchasing and financial management, procurement compliance and financial stewardship for an average of $125M in annual expenditures. The Construction Contract Administrator is responsible for the application and utilization of construction services, statutory guidance, administrative rules, policies, principles, and practices related to the drafting and negotiation of complex construction and design contracts and modifications for procurement of construction, goods, professional services and the development of contracts. This is a key position and serves as a resource to the Office of Design and Construction (ODC), campus partners and University suppliers. Construction contract management for the University is critical for the success of our education and research mission and requires a customer-focused individual who understands the positive impact of strong contract management practices. The person in this role will work with campus partners and contractors to ensure projects are procured and contract payments are processed accurately and timely. They will be responsible for providing analysis and expertise for capital construction and controlled maintenance projects, contracts, and procurement needs, analysis and guidance on services, goods, and encumbrance requirements for ODC and campus. This position is responsible for understanding the complexities of state and federally funded capital construction and the correct application of all related compliance. This is a professional position that requires critical thinking and strong analytical skills. The Construction Contract Administrator must be able to work independently, research and resolve issues, strategically analyze complex contracts, consistently review processes and procedures, make recommendations for improvements, and develop and deliver training to campus partners. Knowledge and understanding of when to apply any specific construction delivery methods is critical. The ideal candidate enjoys working with complex construction contracts and collaborating with others to resolve unique challenges. The person in this role will learn how to decipher intricate state forms, pay applications, policies, and other documents as required for this role. This position is hybrid in Colorado. The Colorado School of Mines provides dedicated professional development and training. Onboarding for this position includes training on financial systems, policies, procedures, and regulatory compliance requirements for state and federal contracting. Specific duties include: Managing the contracting process including compliance and completeness of Mines ODC contracts and ODC construction, architectural/engineer, and design services contracts, and the appropriate approvals: Understand and enforce compliance of construction as it relates to Mines and State of Colorado procurement rules during the solicitation and purchasing process of goods and services needed by ODC. Prepares appropriate contracting documents as prescribed by State and Mines contract templates for the needs of Mines as identified by ODC. Understand and enforce Prevailing Wage/Davis Bacon requirements for construction contracts; including project entry, wage and vendor assignment, and review and approval of Certified Payrolls submitted by vendors through the LCPTracker Software. Reviews contract and the general requirements of the construction specifications prepared by Architect/Engineer prior to bidding to assure legislative and State Buildings Programs’ requirements are adhered to in support of the project and the overall mission of the Capital Construction and Controlled Maintenance programs. Reports contracting issues or problems to project managers for resolution. Obtains appropriate bonds and certificates of insurance as necessary for contract type; verifies certificates of insurance from all vendors to assure necessary coverages. Reviews and facilitates and/or assists Contractor in preparation of change order proposals and change orders to assure accurate mark-up of costs and changes for contract completion dates Prepares amendments and/or supplements for professional and construction agreements. Routes all documents for proper signatures and execution and obtains clarification of contract requirements if necessary. Analyze and apply a complicated/complex set of laws, rules, and guidelines to determine appropriate procedures and scheduling of advertising, prequalifying contractors, selection of professional services firms and bidding processes to avoid protest, appeals or lawsuits which would negatively impact project schedule and cost. Applies administrative project management skills for necessary document execution and record keeping for project timeliness and contract enforcement to avoid or prepare for potential legal action and project management procedures. Supports the State of Colorado Buildings Delegate, the Risk Manager, Principal Representative and legal counsel in the processing of contractor claims. This includes research, providing data related to the claim for evaluation and dispute resolution, and provides accurate information to the Director of ODC. Manage and administer ODC and University Architect purchase requests, administer competitive solicitations, and negotiate applicable terms and conditions: Examines purchase requests for various factors including completeness, fiscal responsibility and urgency, and to determine the most effective method of procurement that will provide the requested purchase in a timely manner while maximizing competition. Analyzes and applies a complicated/complex set of laws, rules and guidelines to determine appropriate procedures and scheduling of advertising, prequalifying contractors, selection of professional services firms and bidding processes to avoid protest, appeals or lawsuits which would negatively impact project schedule and cost. Develops language and format for Advertisement for Bids (AFB), Invitation for Bids (IFB), Request of Proposals (RFP), and Request for Qualifications (RFQ) on web-based bidding platform (currently BIDNET) when applicable, assuring compliance with rules, regulations, and laws. Ensures all solicitation documents are complete and accurate. Involves review of contract specifications for completeness, and that front-end documents are included, Serves as primary point of contact for all advertisements; advises potential bidders of applicable rules, requirements and procedures. Provides professional purchasing expertise, counsel and assistance to ODC, regarding purchasing procedures. Assist ODC with requisitions and purchase orders. Reviews responses to solicitations received for acceptability per solicitation requirements including bonding requirements. Coordinates and manages selection committees and project managers for review and selection on solicitation responses. This includes, but is not limited to, collaborating with ODC in establishing scoring criteria, preparing evaluation documents, setting up interviews, and establishing a short list for selection. Lead the project Close Out process to ensure a comprehensive closeout with ODC and General Accounting: Manage and administer contract and project closeout including code compliance review, LEED requirements, and reporting to the State as statutorily required. Provides budget reporting and reconciliation for projects to General Accounting, Director of ODC and others as needed. Works in concert with project managers to assure close-out is completed in a timely and consistent manner and all contractual obligations are met. Prepares and coordinates all legal notices required by State or Federal government, and contractor final payments including retainage held. Ensure contracts comply with the State Buildings and Colorado Commission on Higher Education requirements, policies and procedures to the procurement process in support of ODC: Review and incorporate at least annually all State of Colorado construction contracts, modifications, notices, solicitations, and processes, including working with Mines staff to update contract database and conducting meetings with ODC to review updated materials. Assists ODC in annual OSA Reporting. Works with Office of State Architects (OSA) on emergency project contracts. Prepares monthly reporting to United States Depart of Commerce on major construction projects. Prepares bond status reporting as needed. Assist with internal and external audits related to construction and purchasing processes. Manage contracting and purchase data and participate in process reengineering: Participate in and contribute to procurement process reengineering. Partner with teams who impact or are impacted by processes in Procurement and Contracting Fundamentally understand, recommend, and implement process changes that will positively impact the procurement process for Mines.
