DutiesAbout The PositionLeads the Enforcement staff comprised of regional operations, data analytics and case management operations, public education, and engagement on compliance with the law, and staff training and development to promote enforcement priorities across both OCR's national headquarters and the CCMO and at least 33 percent of OCR's regional offices. Provides direct and ongoing supervision for senior staff who advise on and implement these activities, including one or more Associate Deputy Director for Enforcement and Senior Enforcement Advisors.
Provides expert advice and guidance to the OCR Director and other senior leadership, regulatory partners, health care providers, health plans, health clearinghouses, privacy groups, civil rights organizations and others on data-driven case management operations, OCR's legal authorities, regulatory agenda, and public-facing resources.
Provides executive leadership and managerial direction to professional, technical and support personnel engaged in a variety of broad substantive issues related to: (1) implementing and overseeing enforcement of privacy rule-related programs in the Regional Offices; (2) coordinating civil rights and HIPAA privacy rule programs and policies to avoid duplication of effort and inconsistent activities and to assure prudent and effective policies that meet program goals; (3) implementing nationwide compliance and enforcement programs and policies to protect the privacy of protected health information held by health insurers and certain health care providers and to protect the public from discrimination in certain healthcare and social service programs; (4) recommending, as appropriate, and assisting formulation and implementation of policy for compliance and enforcement of non- discriminatory access to health care and privacy and security of protected health information; (5) enforcing Federal laws and regulations related to civil rights and health information privacy; (6) providing assistance and input in development of policies necessary for implementing OCR's mission; (7) providing the functional leadership, oversight, supervision, and coordination necessary to plan, coordinate, and execute activities necessary to timely process and resolve complaints, and to determine compliance with and enforce, as necessary, the requirements of the HIPAA Privacy and Security Rules, the Patient Safety and Quality Improvement Act confidentiality protections, and various civil rights authorities. The efforts will be carried out in cooperation with other OCR Deputy Directors and senior staff. Builds new data analytics tools and platforms that strategically inform case management processes and identifies relevant trends in a regular, systemic fashion. Identifies, develops, and oversees the implementation of tools and platforms by which OCR can analyze and measure activities across OCR.
Collaborates with OCR leadership and programmatic divisions to oversee and maintain strong enforcement of the law and case management operations that ensure the efficient and effective processing and evaluation of complaints, from intake to final disposition. These processes include routine and systematic analysis of operations and relevant data analytics to inform strategic decision making.

QualificationsAs a basic requirement, applicants must demonstrate progressively responsible leadership experience that is indicative of senior executive level managerial capability and directly related to the skills and abilities outlined under the Mandatory/Technical Qualifications and Executive Core Qualifications listed below. Typically, experience of this nature will have been gained at or above the equivalent of the GS-15 grade level in the Federal service or its equivalent with state and local government, the private sector, or non-governmental organizations. Failure to meet this basic qualification requirement and all executive and technical qualification factors will automatically exclude you from further consideration.All competitive candidates for SES positions with the Federal Government must demonstrate leadership experience indicative of senior executive level management capability. To meet the minimum qualification requirements for this position, you must show in your resume that you possess the Fundamental Competencies, five Executive Core Qualifications (ECQs), and the Mandatory Technical Qualifications (MTQ's), listed below. It is recommended that your resume emphasize levels of responsibility, scope and complexity of programs managed, and program accomplishments and results.

Mandatory Technical Qualifications (MTQ's)This position also requires that you possess MTQ's that represent knowledge, skills, and abilities essential for success in this role. The following MTQ's must be evident in your resume.
  • Demonstrated experience in leading professional, technical and support personnel engaged in compliance, enforcement, and outreach activities involving Federal laws and regulations related to one or more of the following areas: civil rights, health information privacy, or conscience and religious non-discrimination.
  • Demonstrated knowledge and experience in analyzing a wide range of legal issues and communicating to advance compliance or enforcement of Federal laws or policy of the highest priority/visibility while coordinating and collaborating with internal stakeholders to achieve program goals and objectives.

IF SELECTED, you will be required to complete an ECQ package by drafting narratives for each of the ECQs and be certified by an OPM Qualifications Review Board (QRB) in order to be placed in this position. If you are currently serving in a career SES appointment, are eligible for reinstatement into the SES, or have successfully completed an SES Candidate Development Program approved by the Office of Personnel Management (OPM), you WILL NOT need to draft the ECQs.

Additional InformationSalary for Senior Executive Service positions varies depending on qualifications. The annual salary range may be found at the top of this announcement. This position may be eligible for performance bonuses and performance based pay adjustments.
Probationary PeriodAn individual's initial SES career appointment becomes final only after the individual successfully completes a one year probationary period.
