BASIC PURPOSE AND SCOPE OF POSITION:This role serves as the Customs compliance subject matter expert and leads and develops our internal international trade compliance program related to import /export activities and ensuring KTC and KNA compliance with applicable laws, regulations and best practices. Partners with customs brokers and other providers to monitor, audit, report and improve import / export related activities and to develop, validate, and improve processes and procedures to ensure regulatory compliance. This position will support KNA FTZ programs as needed. Import / Export Compliance Manager works closely with other departments such as Accounting, Legal, Warranty, Sales, Warehouses receiving & shipping, etc. ​in support of compliance goals for Supply Chain Operations.This person will create reporting for KNA/KTC leadership around customs compliance program and will keep all aware of risk or new customs laws that have in impact on the Kubota. This role combines the need for strong cross-functional leadership and highly technical skills to ensure all aspects of compliance are adhered to across the organization.PRINCIPAL ACTIVITIES: This position does the following in accordance with all applicable Federal, State and local laws / regulations and the Company’s policies, procedures and guidelines:Oversee and implement import and export compliance activities and ensure full compliance with import/export operational procedures and government regulationsEstablish holistic internal trade compliance program and foster compliance across all areas of the organizationDevelop procedures, training modules, and assessment programs to identify compliance defects and areas of risk; develop solutions, and coordinate process improvementsEnsure compliance manuals and related policies are established and maintainedClassify and record all products with proper tariff classification HTS codes through partnership with operational teamsDetermine applicability of Antidumping/Countervailing Duties, Section 301 duties and Section 232 dutiesEnsure proper declarations on all import and export filings, including HTS/Schedule B, value, partner government agency requirements (PGA), ECCN, etc.Perform entry admissibility review for all future products (e.g., PGA's and other potential roadblocks)Manage Post Entry Audit and Value Reconciliation processing and reporting as applicableCTPAT program, binding customs ruling requests, and country of origin determination as applicableRegister for and manage special tariff and trade programs as determined; complete internal assessments for continued participationEnsure detailed filing system of all import and export filings and required documents are complete, accurate, and accessibleEnsure the company is compliant with all new laws applicable to trade compliance; complete on-going training to stay abreast with trends & additional compliance opportunitiesPerform internal trade compliance audits to assess business risk and implement process improvements and report findings to Leadership.Interface with customs brokers, suppliers and service providers to ensure consistency with defined import/export processes and full compliance for all transactions, including issuance of clearance instructions, monitoring record keeping, and internal and external auditing.Maintains country specific records, Free Trade Agreement (FTA) files, prepare forms required for global import/export, as applicable.Audit import entries and export transactions as applicable, to reconcile and ensure accuracy of broker charges. Verify and validate third party invoices and supporting documentation for duties, fees, surcharges, penalties, detention charges, etc., code and approve for Accounts Payable. Work with customs broker to resolve questions and provide information as needed for timely Customs clearance.Cooperate and partner with Steam Ship Lines and other carriers and import operations team as applicable, on freight payments, bill audits, reconciliations, negotiations and coordination of shipments. Facilitate ocean transit claims resolution and settlements.Assist with the creation and standardization of compliance programs, including writing SOPs and conducting trainings.Support procedures to coordinate between dedicated service providers, KTC transportation provider, KTC distribution centers and Kubota international group / vendors.Participate in continuing education and in turn, assist in training internal departments in areas related to CBP compliance and other government regulations that may affect the import of Kubota TractorImport/Export Compliance Specialists. Perform research and special projects as assigned. MINIMUM QUALIFICATIONSEDUCATION, CERTIFICATIONS, AND TRAINING:Bachelor’s degree in business management, supply chain, or logistics.5-7 years of experience in the same role / capacity.Licensed Customs Broker requiredDetail oriented and strong analytical background.Strong computer skills in Microsoft Office, Integration Point, and SAP (preferred)Good leadership, presentation, oral and written communication skills Excellent problem-solving/analytical skillsDemonstrated experience in the clearance of import shipments in US, overseeing and managing export compliance process, customs brokerage, interactions with broker and Customs and Border Protection, as well as other US Government regulatory agenciesExtensive knowledge of import regulations, including CTPAT, FTAs, NAFTA, EPA, etc., ISF processPractical experience in supporting FTZ and related controls and entriesExcellent working knowledge of Harmonized Tariff Schedule / commodity classification process and INCOTERMSExperience dealing with Customs Border Control and FTZ GranteeUnderstanding of wholesale distribution logistics, proficiency in systems, business software applications, reporting, analysis and interpretations, excellent verbal and written communication skills, leadership skills, judgment, creativity, flexibility, excellent motivation and management abilities as well as exceptional customer service skills.Ability to travel up to 15% of your timeLANGUAGE REQUIREMENTS:Must be able to read, write and communicate effectively in English.PHYSICAL REQUIREMENTS:Typical office environment.
