About The PositionThe Montgomery County Council is seeking a Legislative Attorney for the Montgomery County Council. The primary purpose of this position is to provide legal services, including advice and counsel and legislative drafting, to the Council, Councilmembers, and Council staff.
The position supports the work of the Council, Council committees, Councilmembers, and Council-appointed committees and task forces. Responsibilities include researching and drafting bills, resolutions, zoning text amendments, opinions, regulations, and similar instruments; reviewing and revising legislation submitted by the Executive Branch, Planning Board, and other agencies; preparing staff reports to identify, explain, and analyze complex legal issues; proposing options, recommending solutions, and providing legal advice and guidance to the Council in writing and orally; and providing information to the public and news media.
Independence, exemplary legal research and writing skills, and the ability to provide complex and sound legal advice are essential to the position.
Responsibilities The following are examples of potential duties and responsibilities:
  • Drafts bills, resolutions, zoning text amendments, ordinances, regulations, opinions or other legal instruments as requested by the County Council.
  • Provides legal staff support at Council legislative sessions, work sessions, and public hearings by preparing appropriate documents and background materials for Council consideration and by providing legal advice.
  • Conducts legal and policy research and analysis and identifies solutions to problems or issues.
  • Provides advice to the County Council and individual Councilmembers concerning complex legal issues.
  • Reviews draft legislation, regulations, resolutions and other legal documents proposed by the executive branch or other parties.
  • Monitors development and enactment of federal and state legislation for possible impact on local laws.
  • Coordinates legislative and regulatory matters with Council staff and, as appropriate, with the County Attorney's office, executive branch or other concerned agencies.
  • Represents the County Council at meetings of County boards, committees, commissions, administrative bodies, task forces, and citizens' groups as required.
  • Responds to citizens' inquiries under the Maryland Public Information Act and represents the Council before compliance boards.
  • Performs other job-related duties as assigned.

The anticipated salary range for this position is $ $104,007 to $168,473. Additional Employment Information

Montgomery County Ethics Law: Except as provided by law or regulation, the County's "Public Employees" (which does not include employees of the Sheriff's office) are subject to the County's ethics law including the requirements to obtain advanced approval of any outside employment and the prohibitions on certain outside employment. The outside employment requirements of the ethics law can be found at 19A-12 of the County Code . Additional information about outside employment can be obtained from the Ethics Commission website.
Minimum Qualifications MINIMUM QUALIFICATIONS: Experience:Four (4) years of professional experience as an attorney, at least one year of which must have been spent researching legal issues and drafting legislation, regulations, legal opinions, or other legal documents.
Education:Graduation from an accredited school of law.
Equivalency:None.
License: Membership in the Maryland Bar required within one (1) year of employment.
Preferred Criteria PREFERRED CRITERIA: QualificationsThe applications of those individuals meeting the minimum qualifications will be reviewed to determine the extent, relevancy of training, and experience in the following areas:
  • Experience drafting regulations, legislation, legal opinions, pleadings, motions, or other legal documents;
  • Experience conducting research and analysis of complex legal issues;
  • Strong presentation skills;
  • Experience providing accurate, clear, and concise advice and counsel; and
  • Experience collaborating and developing partnerships.
