MWH Constructors , a leader in water/wastewater treatment facility construction, is seeking a skilled Construction Claim Attorney to join our Legal team in Irvine, CA. The Attorney will be responsible for supporting live projects on construction issues and disputes including legal analysis of damages and schedule issues, claim review, preparation and drafting, and resolution through negotiations and dispute resolution processes.

Essential Functions

  • Evaluate, manage, and resolve claims related to construction projects.
  • Conduct thorough investigation of construction claims by reviewing project documentation and interviewing and coordinating with project management and staff.
  • Prepare detailed claims reports and maintain accurate records of various projects' claims statuses and resolutions.
  • Review and negotiate agreements, including, but not limited to, prime subcontracts, and related documents to identify and mitigate potential claims.
  • Advise on contractual risk and provide recommendations to minimize exposure.
  • Represent the company in negotiations, mediations, arbitrations, and litigation related to construction claims.
  • Collaborate with internal and external legal counsel.
  • Ensure compliance with all relevant laws, regulations, and company policies.
  • Support the Legal department in developing and implementing risk management strategies to prevent future claims.
  • Provide legal advice and support to project teams throughout the construction process.
  • Draft and review legal documents, including claims correspondence, settlement agreements, and pleadings.
  • Stay updated on industry trends, legal developments, and best practices in construction law.

Basic Qualifications

  • Juris Doctor (J.D.) degree from an accredited law school
  • Active license to practice law in the state(s) of operation
  • 5 years of claims experience
  • Comprehensive knowledge of industry business practices (including alternative project delivery methods) and the drafting and negotiation of prime contracts, subcontracts, teaming agreements, joint venture agreements, LLC operating agreements, project management agreements, parent company guarantees, and related contracts
  • Minimum 5 years of related work experience within an engineering or construction company, or a law firm in the construction and/or engineering field.
  • In-depth knowledge of construction law, contracts, and claims resolution.
  • Strong negotiation and communication skills.
  • Ability to work collaboratively with Legal team members and corporate support functions.
  • Ability to provide reporting on various matters via various means.
  • Ability to navigate Microsoft suite and ability to prepare work in Excel.
  • Ability to work independently and collaboratively in a fast-paced environment.

Preferred Qualifications

  • CMAR, CM/GC, and Progressive Design-Build experience preferred.

Compensation

  • The anticipated compensation for this role is between $120,000 - $185,000 based on relevant experience.
