The State of New Hampshire, Department of Environmental Services, Commissioner's Office, Legal Unit has a full time vacancy for an Attorney IV - Legal Unit Administrator.

Summary:

Administers NH Department of Environmental Services (NHDES) legal objectives by authorizing and developing Administrative Rules and coordinating the statewide implementation of major environmental compliance policies, procedures, and initiatives as well as the implementation of federal requirements in lieu of the US EPA. Oversees the administration and the interrelationship of NHDES compliance policies and compliance measurements with state, regional, and federal objectives.

18 Months of additional relevant experience = Associate's degree

MINIMUM QUALIFICATIONS:

Education: J.D. from an American Bar Association recognized law school.

Experience: Six years' experience in the active practice of law.

License/Certification: Valid driver’s license and /or access to transportation for statewide travel.

Special Requirements: Must be an active member of the New Hampshire Bar Association and in Good Standing.

Preferred Work Traits: Thorough knowledge of program administration and evaluation. Thorough knowledge of common, statutory and constitutional laws, and judicial procedures and rules. Ability to express ideas clearly and concisely both orally and in writing. Ability to evaluate and analyze program effectiveness and resource utilization. Ability to speak before public groups and legislative committees. Ability to render effective decisions and deal tactfully with the courts, law enforcement officials, state department heads and the public. Ability to establish and maintain effective working relationships with federal, state and other public officials. Must be willing to maintain appearance appropriate to assigned duties and responsibilities as determined by the agency appointing authority.

Responsibilities:

Authorizes the development and implementation of standardized policies, procedures to ensure the successful long-term implementation of NHDES’s regulatory and non-regulatory programs, including the implementation of federal requirements by NHDES in lieu of the US EPA.

Advises NHDES senior officials, managers, and program professionals on proper interpretation and implementation of state and federal statutes and rules and develops training to ensure that NHDES actions are within the scope of its authority and consistent with applicable federal law.

Monitors NHDES regulatory programs to evaluate their efficiency and effectiveness, evaluates legislative needs and recommends legislative changes. Drafts and reviews legislation, and appears before legislative committees as an official representative of NHDES to ensure the enforceability of NHDES programs.

Monitors the preparation and issuance of all enforcement documents and the preparation and filing of all rulemaking documents to ensure conformance with applicable laws and to ensure viability of NHDES rules and enforcement action.

Assess the fiscal impact and potential conflict with Part 1 article 28-a of the NH Constitution for each proposed rule.

Oversees the administration and interrelationship of NHDES compliance policies and compliance measurements with state, regional, and federal objectives

Manages the NHDES Legal Unit by developing legal staff through timely performance management, promotion of professional and individual development, coaching and counseling, and addressing other human resource management issues, to enable the unit to function efficiently and perform effectively.

Participates in regional and national workgroups on compliance assurance and compliance measurement, and works with NHDES staff and external stakeholders to develop innovative ways to encourage and measure compliance with environmental statutes and rules.

Monitors the management of NHDES files to ensure that information is appropriately disclosed or protected.

Continually seeks to improve practices to add quality and value in support of the Department’s mission while identifying and eliminating unnecessary or redundant actions.
