SUMMARY:
Manages real estate activities for the acquisition and divestiture of various real property assets and related commercial transactions for electrical infrastructure, including transmission and distribution lines, renewable generation and battery storage facilities, including switchyards and substations, and telecommunications and fiber optic cable; manages tribal negotiations and financial settlements for facility and transmission lines right-of-way renewals and easements, including developing business strategy, valuation and cost structure; as part of economic development team, leads major initiatives for the siting, routing and purchase of large land and easement acquisitions for renewable generation resources and new transmission infrastructure; represents company in public process before planning and zoning committees, utility commissions, and other governmental boards, to advocate for approval of capital projects; guides company direction on proposed policy and legislation and serves as company representative in legislative proceedings related to land management and use; provides legal analysis regarding land acquisition, management and use for the construction, operation and maintenance of energy infrastructure; and serves as company legal witness in condemnation actions and other legal land-related proceedings. Manages company right-of-way agents, document management specialists, and contract land specialists, surveyors, appraisers, and other land specialists.
ESSENTIAL DUTIES AND RESPONSIBILITIES:
Manages all aspects of land and easement acquisition and negotiations for electric transmission and distribution facilities, telecommunications and fiber optic infrastructure, tribal right-of-way acquisitions, tribal easement renewals and fee acquisitions. Manages preparation, review and negotiation of areements, easements, permits, licenses, right-of-way agreements and associated access, surface use agreements, encroachments and other land rights.
Represents company in the public process to ensure land and project siting and acquisition requirements are met and the property owner, local community and other stakeholder concerns and needs are taken into consideration.
Serves as company representative to government entities, including Tribal government, Bureau of Indian Affairs, Bureau of Land Management, Department of Transportation, New Mexico Land Office, and others, in the land siting and acquisition process.
Informs and guides company on proposed new or changing public policy and legislation. Tracks, reviews, and analyzes emerging issues for the company related to property rights and land use.
Conducts land acquisition valuation, manages negotiations, prepares settlement documents, including financial requirements and payment structure.
Prepares annual Land Services budget and strategic plan; provides goals and objectives and ensures proper cost management in area of responsibility.
Budgets, hires, and maintains adequate staffing of right of way agents, document management specialists and contract land professionals. Trains and mentors staff.
Motivates and builds team environment, manages conflict, delegates, and practices innovative management skills
Manages workload and project assignments to right of way agents, document management specialists and contractors. Manages workflow through project management software (i.e.. Land Works and Maximo).
Ensures consistent processes and strong adherence to Code of Federal Regulations for right-of-way standards and ensures conformance to company and department procedures and safety requirements
Manages workflow through project management software (i.e., Maximo and Land Works).
Oversees document management by ensuring consistency of documentation; oversees records retention and conformance with Company's records management system
Stays current in areas of expertise, solves, and assists in problem-solving related to the team and department
COMPETENCIES:
Extensive knowledge of right-of-way acquisition, regulation, legal requirements, and processes
Extensive knowledge of tribal relations and tribal land regulations and property rights.
Knowledge of electric utility industry, including construction and maintenance activities associated with transmission/distribution and generation facilities
Ability to analyze complex right-of-way acquisition situations, identify strategy, assign resources, and develop and implement strategy for execution, and ensure proper documentation and follow up
Ability to prepare and understand surveying principles including survey and legal descriptions and map and plat reading, etc.
Highly motivated team player with strong leadership skills
QualificationsMINIMUM EDUCATION AND/OR EXPERIENCE:
Bachelor's degree from a four-year college or university with nine to eleven years of related experience, or equivalent combination of education and/or experience related to the discipline.
CERTIFICATES, LICENSES, REGISTRATIONS:
Must possess a current, legally valid driver's license and meet the company's driving record requirements.
SUPERVISORY RESPONSIBILITIES:
Hires, trains, evaluates, rewards, and terminates employees. Designs, organizes, prioritizes, schedules, and leads work assignments.
COMMUNICATION SKILLS:
Advanced oral and written communication skills
Ability to read, analyze, and interpret common scientific and technical journals, financial reports, and legal documents
Ability to read and interpret documents such as safety rules, operating and maintenance instructions, and procedure manuals
Ability to respond to common inquiries or complaints from customers, governmental and tribal agencies, or members of the business community
Ability to write clear, concise documents, memos and correspondence that conform to prescribed style and format
Ability to effectively present information to staff, department director and senior management, public groups, and/or boards of directors
MATHEMATICAL SKILLS:
Ability to apply mathematical operations to compute long term lease and ROW payments, present and future values, etc.
COMPUTER SKILLS:
Knowledge of word processing and spreadsheet software
ANALYSIS AND PROBLEM-SOLVING ABILITY:
Ability to apply principles of logical or scientific thinking to a wide range of intellectual and practical problems. Ability to deal with nonverbal symbolism (formulas, complex legal descriptions, graphs etc.,) in its most difficult phases. Ability to deal with a variety of abstract and concrete variables.
PHYSICAL DEMANDS:
While performing the duties of this job, the employee is regularly required to walk and sit up to 2/3 of the time. Manual dexterity required, good vision, and the ability to talk and listen. Ability to stoop, kneel crouch, crawl, climb, and balance. The employee must occasionally lift and/or move up to 10 pounds. May be exposed to outdoor weather conditions when working in the field. Occasionally necessary to walk long distances in field on various ROW projects.
WORK ENVIRONMENT:
Primarily office environment: however, may at times work in the field.
Employees in Services Company may be responsible for providing services to various Holding Company subsidiaries and affiliates.
