We Are Looking For Teammates Who Are

What you will do: Litigate tax and regulatory matters on behalf of SCDOR, issue the department determinations in protested matters, and provide formal and informal legal advice to SCDOR and its employees.
Primary Job Duties Include
  • Analyze files in both tax and regulatory matters, research the issues raised therein, communicate with the taxpayer and their representatives, and draft Department Determinations regarding the protested matters.
  • Conduct research on complex legal issues and draft advisory memos and briefs.
  • Represent the Department in all aspects of tax and regulatory litigation in the Administrative Law Court and other courts.
  • Research and write appellate briefs and handle oral arguments (as necessary).
  • Give formal and informal advice to Department staff and to other state agencies on Department procedures, interpretation or relevant legislation, and other matters of law.
  • Communicate the Department's legal positions to other constituent Governmental entities and seek cooperation from other Governmental entities.
Minimum And Additional Requirements
  • A Juris Doctor degree or its equivalent from an accredited law school and experience as a practicing attorney
  • Must be a member in good standing of the South Carolina Bar
Preferred QualificationsPreferred qualifications are not required but are considered when setting a starting salary within the hiring range.
  • Highly preferred: Strong business litigation experience, LLM in taxation, experience in state and local tax law, or an accounting background
  • Knowledge of the laws of South Carolina, including regulatory and tax laws and regulations relevant to Department of Revenue
  • Knowledge of general case, statutory and common law
  • Thorough knowledge of the judicial and quasi-judicial procedures and rules
  • Ability to interpret laws in court decisions
  • Ability to analyze facts, evidence, and legal instruments
  • Ability to express conclusions and arguments clearly and logically
