The Special Prosecutions and Law Enforcement Section supports and provides legal advice to District Attorneys and law enforcement across the State in addition to representing the State of North Carolina in both criminal and civil litigation.
  • North Carolina Criminal Justice Education Training and Standards Commission. This attorney is the attorney primarily responsible to provide civil and administrative litigation support and legal representation to the North Carolina Criminal Justice Education and Training Standards Commission in complex legal matters that affect the Commission as may be required. It is expected that the attorney will provide day-to-day legal advice to Commission personnel, will handle either alone or with the assistance of other attorneys in the section litigation requirements of the Commission and will provide assistance with the training of Commission personnel in preparing and presenting evidence for court proceedings.
  • North Carolina Sheriffs' Education and Training Standards Commission. This attorney will assist another attorney within the Section who is primarily responsible to provide civil and administrative litigation support and legal representation to the North Carolina Sheriffs' Education and Training Standards Commission in complex legal matters that affect the Commission as may be required.
  • Litigation. In addition to litigation duties outlined above, this attorney will engage in criminal and civil cases assigned to the Special Prosecution and Law Enforcement Section. In this role the attorney may be either the lead attorney or assist others in the Section to litigate cases as assigned.
  • Criminal Appeals. The attorney is responsible for representing the State of North Carolina in the appeal of criminal cases as assigned by the Attorney General's Office. This includes both preparation of briefs and oral arguments.
  • Telephone and Written Inquiries. The attorney is responsible for responding to wide variety of telephonic and written inquiries. Such requests come from police departments, sheriffs' offices, state law enforcement agencies, city and county attorneys, city and county managers, various other city and county personnel, district attorneys, police legal advisors, and members of the General Assembly. Law enforcement inquiries come from officers at the street level of their department as well as from chiefs and sheriffs. Additionally, the attorney is responsible for addressing both written and telephone inquiries for legal explanations on matters and telephone inquiries for legal explanations on matters which are forwarded to this Section by citizens of North Carolina as well as by various members of the news media.
  • Technical Assistance and Special Projects. The attorney provides technical assistance to law enforcement officials on various issues involving criminal justice matters. The specific areas in which assistance is routinely given includes, but is not limited to: search and seizure, hot pursuit, domestic violence, disposal of property, ABC laws, drafting search and arrest warrants, and the formulation of inter-agency mutual assistance agreements. This technical assistance may include public presentations and written publications on topics of interest to criminal justice and other related organizations. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result. THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO $84,878 to $105,500. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity. (1) extensive knowledge of federal and state case law, statutory law and administrative rules and regulations; (2) comprehensive knowledge of arrests, search and seizure statutes and case law at both the federal and state levels; (3) knowledge of the progression of the criminal justice professional entry level, in-service and training standards in North Carolina; (4) knowledge and understanding of the role and responsibilities of the North Carolina Criminal Justice and Sheriffs' Education and Training Standards Commissions; (5) knowledge of the legislative process; (6) criminal justice teaching skill; (7) skill in assisting in the provision of police legal advice to criminal justice officers and agencies; (8) skill in assisting with presentations on complex legal topics to legislators, commissions, professional groups, and the press (9) ability to relate to persons of all educational and socio-economic levels; (10) ability to communicate complex legal concepts in a simple, common-sense manner; (11) ability to translate observations into legal teaching points; (12) considerable knowledge of judicial and quasi-judicial procedures; (13) ability to assist with courtroom litigation and to independently conduct courtroom litigation (14) ability to interpret and apply laws in court decisions; (15) ability to analyze facts, evidence and legal documents; (16) ability to express conclusions and arguments clearly and logically in oral and written form (17) ability to draft briefs, pleadings, opinions, legislation and regulation in clear and precise language; (18) ability to maintain effective working relationships with the public and other persons contacted in the course of the work.
