Bellingham Technical College (BTC) invites applications for one full-time professional exempt position as Director of Compliance & Title IX. This is an exempt, non-represented position, is Fair Labor Standards Act (FLSA) exempt from overtime and is at-will. This position reports to the Vice President of Student Services and is anticipated to start in April 1, 2025. The Director of Compliance will be responsible for the development, implementation, operation, maintenance, and oversight of a college-wide compliance program at Bellingham Technical College (BTC) to ensure the college’s full adherence to the legal, ethical, and regulatory obligations imposed by all levels of government and other oversight agencies, including the NWCCU (Northwest Commission on Colleges and Universities) accrediting body. The areas of focus include, but are not limited to: Title IX Compliance, the Violence Against Women Act (VAWA), Jeanne Clery Act Compliance, Mandatory Reporting of Child Abuse, Washington State Public Records and Records Management, Ethics and Conflicts of Interest, and collaborating on Safety and Risk Management. The Director’s responsibilities will include implementing appropriate processes and procedures to ensure all aspects of college-wide compliance, including coordination of campus areas responsible for compliance, internal and public communications, working with affected department and college administration to remediate compliance deficiencies, and evaluation of compliance risks. The Director is also responsible for the promotion of a college environment that supports observance of the highest ethical standards of conduct by those who work for the College or on its behalf. The Director will develop, coordinate, and participate in a multifaceted educational and training program that focuses on the elements of the compliance program, and seeks to ensure that all appropriate employees and management are knowledgeable of, and comply with, all applicable legal, ethical, and regulatory obligations. The Director will promote professional development and training of individuals on campus who have compliance responsibilities, including participation in professional association activities and conferences, online education, course training modules, etc. The Director’s responsibilities will also include the education of Board of Trustees on key issues of institutional compliance, particularly in those areas where the Trustees have oversight responsibilities.
The Director will serve as the College’s Title IX Coordinator, overseeing the investigation and resolution of complaints, developing and conducting training designed to educate and support employees and students regarding their rights and responsibilities under Title IX, and serving as a resource for campus on matters related to all forms of discrimination, including sex-based harassment. The Director will monitor the College’s policy and procedures in relation to Title IX and ensure that the College meets all its obligations under Title IX of the Educational Amendments of 1972 and 34 C.F.R. Part 106. - Coordinate/implement policies and procedures required for college compliance with public records requests, federal/state civil rights laws, Jeanne Clery Act, and Title IX laws and regulations for students, employees, and the public.
- Develop and manage required programs and activities under the Jeanne Clery Act, and prepare, publish, and distribute the Annual Safety Report.
- Coordinate all aspects of Institutional compliance with Title IX, including education, grievance procedures, prevention strategies, and remediation.
- Lead and coordinate compliance-related investigations as needed, maintaining objectivity, and ensuring a fair and thorough process.
- Manage the Title IX and EEO investigation and resolution process in compliance with College policy, ensuring the implementation of any resulting corrective measures through coordination with appropriate supervisors or departments; maintain intake, investigation, and outcome determination files in both hardcopy and electronic formats as appropriate under federal and state retention requirements.
- Ensure a roster of trained and Title IX Investigator-certified Deputy Title IX Coordinators is maintained; oversee assignment of Deputy Title IX Coordinators.
- Oversee prompt, effective, and equitable review of all reports related to discrimination, including sex-based discrimination; manage full oversight of initial follow up, intake interviews, investigation and resolution of complaints; monitor outcomes, track data related to trends and address any patterns; assess effects on the campus climate; develop regular reporting to college leadership.
- Ensure the investigation process for any complaint received complies with employee collective bargaining agreements where applicable.
- Provide training and development for the College community on awareness, intervention, and prevention of sex-based discrimination, sexual misconduct, relationship violence, and anti- discrimination efforts; monitor program effectiveness and coordinate any changes required for continuous improvement; maintain requisite records of all such training provided within the College.
- Coordinate employee and student enrollment in required annual training, and any necessary follow-up with areas/supervisors to ensure completion, to ensure compliance with Title IX and anti-discrimination efforts.
- Develop and disseminate educational materials (both print and online), that inform members of the College or campus community (employees, students, and parents/guardians) of their Title IX rights, responsibilities, and resources both within and outside of College premises.
- Develop and execute a comprehensive compliance monitoring and auditing program; regularly assess the effectiveness of internal controls and identify areas for improvement.
- Design, coordinate, and participate in educational and training programs to enhance awareness of compliance requirements and responsibilities.
- Collaborate with the Administrative Team members, including the Director of Diversity, Equity, and Inclusion, to support the College bias incident protocols/processes to address hate crimes and incidents, conduct, behavioral concerns, employee relations, and Title IX developments; support efforts for campus understanding/awareness of identity, bias, and discrimination; represent Title IX and discrimination-prevention efforts within the College and community.
- Coordinate the dissemination of information (both print and online) for public records request, the Title IX/EEO complaint process, and available resources.
- Advise College leadership on public records requests, equal opportunity and Title IX issues and information in collaboration with HR and legal guidance, including with the College’s Assistant Attorney General.
- Maintain the Title IX/EEO and public records request database and websites, and the database used to track Title IX complaints.
- Research and analyze complex policy issues, possible legal implications, and the impact of proposed policies and policy revisions on key areas of the institution; consult with subject- matter experts, as needed; ensure policies are published in a timely manner and in a format that is accessible, consistent, and compliant with public records requirements; maintain a schedule for the routine review and revision of existing policies.
- Work closely with various college departments, including Human Resources, Business Office, Enrollment Services, Student Financial Resources, and Outreach, Advising, and Counseling, to ensure that compliance requirements are integrated into respective processes.
- Stay current with developing legislation and regulatory issues that impact higher education by participation in professional communities, attending conferences, and membership/participation in local, regional, or national associations for Title IX.
- Lead, work with, and serve on committees and councils as appropriate.
- Keep current with laws, regulations, and technology that may affect position or assignments.
- Manage allocated budget.
- May supervise, assign schedules, evaluate, and train other staff.
- Assist with other compliance duties as needed or assigned.
- Perform other related duties as assigned.
Required Qualifications:
- Bachelor’s degree from an accredited institution.
- Minimum three years of recent experience in overseeing and directing compliance programs, audits, enterprise risk management, or related fields.
- Minimum two years of successful project management experience including development of sustainable systems.
- Experience developing and leading training or education programs and assessing training effectiveness.
OR
- An equivalent combination of education and experience that provides the applicant with the knowledge and skills sufficient to perform the essential duties of the job will be considered.
AND
- Demonstrated proficiency in the Microsoft Office Suite of programs.
- Ability to demonstrate cultural competence (including an awareness and understanding of historically minoritized populations) that includes a commitment to work with others to create an educational and work environment that affirms commitment to diversity, equity, and inclusion.
Preferred Qualifications:
- Experience in compliance at a higher education institution, K-12 system, non-profit, local, state or federal agency.
- Proven experience with tracking, reading, interpreting, and communicating complex laws, regulations or policies.
- Training in trauma informed practices.
Physical & Work Environment:
Standard office setting with long periods of sitting and working at a computer, using frequent repetitive arm, hand/wrist, and finger movements. Some stooping, bending, twisting, and lifting up to 20 pounds; work in an open office environment with constant interruptions and requirement to answer on demand questions by phone, in person, or electronically. Frequent dealing with stresses, emergency situations, and deadlines. Ability to communicate information and ideas so others understand. Visual acuity to determine the accuracy of work, complete and review forms, input data; Exercise independent judgement in gathering, arranging, and evaluating data. Physically attend meetings both on and off campus, using the ability to communicate in person or through appropriate means. May also work some weekends and evenings when appropriate or needed is required.
Compensation, Benefits and Work Schedule:
The salary is $6,941 per month ($83,292 annual) to $7,482 per month ($89,784 annual), depending on experience.
Position receives 8 hours per month of sick leave, 16 hours per month of vacation leave, 24 hours of personal leave and 12 paid state/college holidays per calendar year. Benefits also include a Washington State insurance package including medical, dental, vision, life insurance, and long-term disability; a retirement benefits package, with choice between the Public Employees Retirement System (PERS) Plan 3 or the State Board Retirement Plan (SBRP) 401A plan TIAA. Work Schedule:
Work schedule is generally Monday through Friday, about 40 hours per week, however, schedule may vary including split, weekend, and evening assignments. The position will be expected to work onsite full-time with possibility of some flexible remote work.
