Role Description
This is a full-time on-site role for an Elder Law Attorney in Schenectady, NY. The Attorney will be primarily responsible for managing community and chronic care Medicaid applications, ensuring compliance with relevant laws and regulations. Additional areas for growth potential include estate planning including the use of various trusts, including Revocable Living Trusts, Irrevocable Trusts, Medicaid Asset Protection Trusts, and Supplemental Needs Trusts, as well as basic Will planning, and the Administration of Trusts and Estates.

Responsibilities
· Analyze complex legal issues related to Medicaid for chronic care and community care.
· Communicate with clients to gather and analyze necessary information, and organization of same for Medicaid applications, including strategic recommendations for spenddowns, promissory notes, spousal refusal and use of pooled supplemental needs trusts, then coordination of independent assessment and establishing care with an appropriate provider within various programs.
· Manage real estate transactions from contract to closing.
· Opportunity for growth into review and drafting of legal documents, including wills, trusts and other estate planning instruments, as well as understanding the income tax impact of planning documents.
· Ensure compliance with local, state, and federal laws governing estate planning.
· Work on Guardianship cases and annual reporting utilizing familiarity with relevant statutes including SCPA Articles 17 and 17A and Mental Hygiene Law Articles 81 and 83.
· Collaborate with support staff to streamline workflow and ensure efficient case management.
· Ability to manage multiple tasks and deadlines effectively and gracefully.
· Perform other duties as needed.
Qualifications
Experience in Elder Law, Medicaid, Guardianship, Estate Planning and Real Estate
Excellent written and verbal communication skills
Strong analytical and problem-solving abilities
Juris Doctor (J.D.) degree and a license to practice law in New York State
Keyboarding and strong knowledge of Word and Excel required; familiarity with Wealth Council, Clio, L/N Hot Docs for Surrogate’s Court a plus.
Salary $70,000 to $85,000, plus possible incentive bonus compensation.
